Matt Gaetz (R-Fla.) introduced a bill Tuesday that would end \u201cunqualified\u201d birthright citizenship for children whose parents are not themselves U.S. citizens. <\/p>\n<p><a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/gaetz.house.gov\/sites\/evo-subsites\/gaetz.house.gov\/files\/evo-media-document\/brithright-citizenship.pdf\">The legislation<\/a>, titled the \u201cEnd Birthright Citizenship Fraud Act of 2023,\u201d would amend the <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.uscis.gov\/laws-and-policy\/legislation\/immigration-and-nationality-act\">Immigration and Nationality Act<\/a> \u201cto reflect the original intent of the 14<sup>th<\/sup> Amendment\u2019s \u2018subject to the jurisdiction thereof,\u2019 clause,\u201d according to a <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/gaetz.house.gov\/media\/press-releases\/congressman-matt-gaetz-introduces-end-birthright-citizenship-fraud-act-2023\">statement on the measure<\/a>.\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr1_ab\"><\/aside>\n<p>The 14<sup>th<\/sup> Amendment grants citizenship to all \u201cborn or naturalized in the United States, and subject to the jurisdiction thereof.\u201d \u00a0<\/p>\n<p>The amendment was passed in 1866, shortly after the Civil War to ensure citizenship and equal rights for formerly enslaved people. <\/p>\n<p>The 1898 Supreme Court case United States v. Wong Kim Ark upheld the idea the 14th Amendment <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>lies to children regardless of their parents\u2019 immigration status. \u00a0<\/p>\n<p>Birthright citizenship has become a favored target of hardline conservatives. Former President Trump, who toyed with moving against it during his time in office, has pledged to end it on his first day in office if he returns to the White House, though experts say a president would lack that legal authority on their own.<\/p>\n<p>If passed, Gaetz\u2019s legislation would deny\u00a0automatic citizenship at birth to children born in the U.S. to parents\u00a0who are not U.S. citizens, while\u00a0\u201cexcluding aliens lawfully admitted as refugees or permanent residents or performing active services in the U.S. Armed Forces.\u201d\u00a0<\/p>\n<p>The bill claims birthright citizenship has \u201cenabled an entire black market,\u201d citing estimates of 33,000 births to women on tourist visas annually, and \u201chundreds of thousands more,\u201d born to undocumented immigrants or those on temporary visas, \u201cmany of whom have misrepresented the purpose of their <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/trip-and-travel\/\" data-internallinksmanager029f6b8e52c=\"10\" title=\"Trip &amp; Travel\" target=\"_blank\" rel=\"noopener\">trip<\/a> to avoid scrutiny.\u201d <\/p>\n<aside class=\"ad-unit ad-unit--mr2_ab\"><\/aside>\n<p>It is not clear if the removal of birthright citizenship can happen through legislation.\u00a0<\/p>\n<p>\u201cBirthright citizenship has been grossly misapplied for decades, recently becoming a loophole for illegal aliens to fraudulently abuse our immigration system,\u201d Gaetz said in a statement, adding his bill shows \u201cAmerican citizenship is a privilege \u2014 not an automatic right to be co-opted by illegal aliens.\u201d<\/p>\n<p>The Florida Republican, a member of the House Judiciary Committee, said the bill will \u201cpreserve the sanctity of American citizenship,\u201d and ensure citizenship is something that is \u201cearned,\u201d from legal migration to the U.S. \u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr3_ab\"><\/aside>\n<p>The bill comes as the Judiciary panel is <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/judiciary.house.gov\/committee-activity\/hearings\/oversight-us-department-homeland-security-0\">slated to question<\/a> Homeland Secretary Alejandro Mayorkas on Wednesday regarding the agency\u2019s operations and immigration in particular.\u00a0\u00a0<\/p>\n<\/div>\n<p>Copyright 2023 Nexstar <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/social-mediaa\/\" data-internallinksmanager029f6b8e52c=\"1\" title=\"Social Media\" target=\"_blank\" rel=\"noopener\">Media<\/a> Inc.
