{"id":584832,"date":"2023-07-29T13:00:00","date_gmt":"2023-07-29T10:00:00","guid":{"rendered":"https:\/\/en.buradabiliyorum.com\/latest-trump-charges-put-spotlight-on-consciousness-of-guilt\/"},"modified":"2023-07-29T13:00:00","modified_gmt":"2023-07-29T10:00:00","slug":"latest-trump-charges-put-spotlight-on-consciousness-of-guilt","status":"publish","type":"post","link":"https:\/\/buradabiliyorum.com\/en\/latest-trump-charges-put-spotlight-on-consciousness-of-guilt\/","title":{"rendered":"#Latest Trump charges put spotlight on \u2018consciousness of guilt\u2019"},"content":{"rendered":"<p><img decoding=\"async\" src=\"https:\/\/thehill.com\/wp-content\/uploads\/sites\/2\/2023\/07\/news-illustration_trumpdonald_072823mm-ap-see-credits_evidence.png?w=900\" \/><\/p>\n<div>\n<p>Powerful new evidence in the Mar-a-Lago case accusing former President Trump of personally directing the deletion of security footage at his Florida estate could bolster prosecutors\u2019 case and demonstrate the former president acted to conceal his guilt.<\/p>\n<p>The superseding indictment filed Thursday night details an effort by Trump, his valet Walt Nauta and a new co-defendant, Carlos De Oliveira, to delete security footage showing boxes being moved in and out of a Mar-a-Lago storage room.\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr1_ab\"><\/aside>\n<p>De Oliveira, head of the maintenance team at Trump\u2019s Florida home, spoke with others about how long security footage remained in the system, telling another Mar-a-Lago employee that \u201c\u2018the boss\u2019 wanted the server deleted.\u201d<\/p>\n<p>The indictment alleges Trump was personally involved in directing the effort to delete the footage, noting a 24-minute call with De Oliveira the day after prosecutors flagged plans to subpoena security camera video.\u00a0<\/p>\n<p>It goes on to describe Nauta and De Oliveira moving through bushes on the property and taking stock of where security cameras were located.<\/p>\n<p>\u201cHere is a plan led by him involving and implicating his two co-conspirators \u2026 to destroy security footage presumably because Trump was concerned that it showed the movement of these boxes containing the classified documents around Mar-a-Lago. That\u2019s so probative of his state of mind and his bad intent to obstruct justice,\u201d Norm Eisen, counsel for Democrats in Trump\u2019s first impeachment, told The Hill.<\/p>\n<p>\u201cIt\u2019s such a gripping narrative for a jury, with the defendants sneaking around the property and taking pictures of where the surveillance cameras are, going through tunnels and climbing through the bushes to meet. And then Trump placing calls at the beginning and the end of that new section of the complaint. So it\u2019s a big upgrade for [special counsel] Jack Smith, and he\u2019ll need it.\u201d<\/p>\n<p>The superseding indictment, filed when prosecutors have additional charges and evidence, adds two counts of obstruction of justice for Trump in connection with attempting to delete the footage.<\/p>\n<aside class=\"ad-unit ad-unit--mr2_ab\"><\/aside>\n<p>It also adds another count to the number of Espionage Act charges facing Trump, now totalling 32, that includes military plans concerning Iran that Trump boasted of having while lamenting he never declassified the documents while president.<\/p>\n<p>Its inclusion is in part significant because Trump denied ever having the document, telling both ABC <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/news\/\" data-internallinksmanager029f6b8e52c=\"2\" title=\"News\" target=\"_blank\" rel=\"noopener\">News<\/a> and Semafor that it was just a handful of unrelated papers.<\/p>\n<p>\u201cI would say it was bravado; if you want to know the truth, it was bravado,\u201d Trump said in June. \u201cI was talking and just holding up papers and talking about them, but I had no documents. I didn\u2019t have any documents.\u201d\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr3_ab\"><\/aside>\n<p>Details about the alleged plot to delete the footage could be especially significant in the case, as experts say it shows a guilty mindset that is often compelling to juries.<\/p>\n<p>Danya Perry, an attorney who helped draft a model prosecution memo for the Mar-a-Lago case, called it \u201cincredibly devastating and inculpatory evidence.\u201d<\/p>\n<p>\u201cHere what you see is what is called in the law \u2018consciousness of guilt,\u2019 which is typically very persuasive evidence in front of a jury that the defendant in question knew what he was doing was wrong. It\u2019s contemporaneous actions to conceal or destroy or cover up evidence or misconduct,\u201d she said.\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr4_ab\"><\/aside>\n<p>\u201cThat can be very damning for a jury who\u2019s trying to peer into a defendant\u2019s state of mind and determine whether or not they have a guilty con<a href=\"https:\/\/buradabiliyorum.com\/en\/category\/sciencee\/\" data-internallinksmanager029f6b8e52c=\"5\" title=\"Science\" target=\"_blank\" rel=\"noopener\">science<\/a>.\u201d<\/p>\n<p>In some respects, Smith had already demonstrated some of that conduct with the original obstruction of justice charges. Those included allegations that boxes were moved to keep them from Trump\u2019s lawyer, and that the former president later motioned for his attorney to \u201cpluck\u201d out any records that might look bad.<\/p>\n<p>\u201cIt\u2019s common sense,\u201d Perry said. \u201cBut most people don\u2019t try and cover up things that they don\u2019t think were wrong.\u201d\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr5_ab\"><\/aside>\n<p>Eisen argued that the latest filing adds clarity that will be compelling to juries who typically like to see evidence defendants knew what they were doing was wrong.<\/p>\n<p>\u201cConsciousness of guilt matters because issues about the defendant\u2019s intent and state of mind are essential for juries to find wrongdoing. Having <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>eared in court now and before juries for more than 30 years, they don\u2019t want to convict people who they don\u2019t believe did wrong intentionally,\u201d he said.<\/p>\n<p>Trump on Friday dismissed the new allegations, calling it \u201ctextbook Third World intimidation by rabid, lawless prosecutors.\u201d<\/p>\n<aside class=\"ad-unit ad-unit--mr6_ab\"><\/aside>\n<p>The superseding indictment does not include allegations about an incident that was referenced in <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/social-mediaa\/\" data-internallinksmanager029f6b8e52c=\"1\" title=\"Social Media\" target=\"_blank\" rel=\"noopener\">media<\/a> reports, namely that De Oliveira drained a Mar-a-Lago pool, flooding the room that housed the servers that stored the surveillance footage.<\/p>\n<p>CNN <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.cnn.com\/2023\/06\/05\/politics\/mar-a-lago-pool-flood-suspicions-prosecutors-trump-investigation-classified-documents\/index.html\">first reported the incident<\/a>, noting that it was unclear whether the flooding was intentional.\u00a0\u00a0<\/p>\n<p>Perry said she was surprised that the incident, if true, went unmentioned in the indictment.<\/p>\n<aside class=\"ad-unit ad-unit--mr7_ab\"><\/aside>\n<p>\u201cThat was pretty evocative reporting,\u201d she said.<\/p>\n<p>\u201cProsecutors are not required to put into an indictment every piece of proof that they might use to support the allegations,\u201d she said, adding, \u201cIt\u2019s not their job to reveal more of it than is necessary.\u201d<\/p>\n<p>Eisen said that may have been a strategic decision by Smith and his team.<\/p>\n<p>\u201cThe reason that the pool draining does not come into the complaint is probably because they were not able to prove that it was intentional. And they didn\u2019t want to weaken their case by giving the defense something to shoot at and introduce evidence that it was an accident,\u201d he said.<\/p>\n<p>\u201cIf it had been useful to them, they would have included it.
