It was his third arraignment this year, after he was indicted in a New York hush money probe and a federal investigation into his alleged mishandling of classified records. Altogether, Trump faces 78 criminal charges \u2014 with a fourth indictment in Georgia likely on the way.<\/p>\n<aside class=\"ad-unit ad-unit--mr1_ab\"><\/aside>\n<p>But the former president is still pummeling competition in the 2024 GOP presidential primary. Trump\u2019s closest competitor, Florida Gov. Ron DeSantis, is\u00a0more than 30 percentage points behind in the polls, <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.realclearpolitics.com\/epolls\/2024\/president\/us\/2024_republican_presidential_nomination-7548.html\">according to RealClearPolitics\u2019s average<\/a>. Other Republican candidates have not polled higher than 6 percent.\u00a0<\/p>\n<p>Trump could also prove a fierce competitor to President Biden if the pair go head-to-head again in 2024. A hypothetical match-up found the two candidates deadlocked, according to a New York Times\/Siena College poll released earlier this week.<\/p>\n<p>As the former president\u2019s legal troubles mount \u2014 and as the 2024 race heats up \u2014 questions about his would-be presidency in the event of reelection are swirling. \u00a0<\/p>\n<p>\u201cWe faced a bigger constitutional crisis when the country had a Civil War,\u201d said Alan Rozenshtein, a law professor at the University of Minnesota. \u201cOther than that, I think this is the worst thing we\u2019ve faced.\u201d\u00a0\u00a0<\/p>\n<p>Here\u2019s what we know about how Trump\u2019s legal woes could affect a future presidency.\u00a0<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Could_Trumps_pending_cases_disqualify_him_from_running\"><\/span>Could Trump\u2019s pending cases disqualify him from running?\u00a0<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>None of the charges Trump faces would bar him from running for president or assuming that role. \u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr2_ab\"><\/aside>\n<p>\u201cThere\u2019s no question that he can be president while indicted,\u201d Rozenshtein said. \u201cIndicted just means that there\u2019s a criminal process going on against you; it doesn\u2019t mean that you\u2019ve been found guilty.\u201d<\/p>\n<p>There are three constitutional requirements to run for president: being a natural-born citizen, a U.S. resident for at least 14 years and at least 35 years old. American voters decide the rest. Whether a candidate has been accused or convicted of a crime has no bearing on their ability to run for president or to ascend to the nation\u2019s highest office. \u00a0<\/p>\n<p>Some civil rights organizations have posited Trump violated the 14th Amendment for his role in the Jan. 6, 2021, Capitol attack, and that such a violation would prevent him from holding office.<\/p>\n<aside class=\"ad-unit ad-unit--mr3_ab\"><\/aside>\n<p>\u201cNo person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any state, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion,\u201d a clause in the amendment reads.<\/p>\n<p>But it\u2019s not clear whether the events of Jan. 6 rise to the level of \u201cinsurrection or rebellion against\u201d the United States, or if the clause bans people from being president, because it\u2019s not explicitly mentioned.\u00a0<\/p>\n<p>Those questions would have to be answered in the courts before Trump could be stopped from holding office.<\/p>\n<aside class=\"ad-unit ad-unit--mr4_ab\"><\/aside>\n<h2><span class=\"ez-toc-section\" id=\"What_happens_if_Trump_is_elected_and_has_these_cases_pending\"><\/span>What happens if Trump is elected and has these cases pending?\u00a0<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>If Trump is reelected before the cases against him are resolved, efforts to delay them until after his presidency would likely succeed, according to Barbara McQuade, a former U.S. attorney and current law professor at the University of Michigan. \u00a0<\/p>\n<p>The Justice Department\u2019s Office of Legal Counsel (OLC) argued in an <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.justice.gov\/d9\/olc\/opinions\/2000\/10\/31\/op-olc-v024-p0222_0.pdf\">October 2000 opinion<\/a> detailing a sitting president\u2019s exposure to criminal prosecution that a criminal case would be too distracting for the nation\u2019s leader, and therefore, not in the country\u2019s best interests.\u00a0<\/p>\n<p>\u201cFor the same reason that the sitting president cannot be indicted, I think that he could not be required to defend himself in a criminal case while serving as president,\u201d she said.\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr5_ab\"><\/aside>\n<h2><span class=\"ez-toc-section\" id=\"Could_Trump_face_jail_time_if_convicted\"><\/span>Could Trump face jail time if convicted?\u00a0<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>If Trump were convicted and given the highest prison sentence available on each charge he faces, he would face hundreds of years in prison. But that outcome is unlikely because the reality of Trump\u2019s situation is much more complicated.\u00a0<\/p>\n<p>None of the crimes Trump faces carries a mandatory minimum sentence, and judges rarely hand down the maximum sentence to first-time offenders.\u00a0Both state and federal judges are given broad discretion in sentencing.\u00a0<\/p>\n<p>Plus, given his\u00a0status and Secret Service protection, the logistics of jailing Trump would be \u201cvery complicated,\u201d McQuade said.<\/p>\n<aside class=\"ad-unit ad-unit--mr6_ab\"><\/aside>\n<p>\u201cIf he is sentenced, I think it is most likely that he will be sent to home confinement,\u201d she said.\u00a0<\/p>\n<p>However, even if Trump were jailed, there is nothing legally that would prevent him from serving as president. \u00a0<\/p>\n<p>In that case, McQuade said she thinks Trump would be released. Rozenshtein said he \u201ccan\u2019t imagine any judge\u201d who wouldn\u2019t \u2014 at the very least \u2014 pause Trump\u2019s incarceration until his presidency concluded.\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr7_ab\"><\/aside>\n<h2><span class=\"ez-toc-section\" id=\"Have_other_presidential_candidates_run_under_indictment\"><\/span>Have other presidential candidates run under indictment?\u00a0<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Trump is the first former president to face criminal charges, but he\u2019s not the only presidential candidate to be indicted \u2014 or convicted \u2014 of crimes.\u00a0<\/p>\n<p><a href=\"https:\/\/buradabiliyorum.com\/en\/category\/social-mediaa\/\" data-internallinksmanager029f6b8e52c=\"1\" title=\"Social Media\" target=\"_blank\" rel=\"noopener\">Social<\/a>ist and labor leader Eugene V. Debs ran for president five times \u2014 the fifth of which, in 1920, he ran from prison after being convicted of sedition for protesting World War I, according to a biography in Middle Tennessee State University\u2019s\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.mtsu.edu\/first-amendment\/article\/1266\/eugene-debs\">\u201cFirst Amendment Encyclopedia<\/a>.\u201d He\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/progressive.org\/latest\/eugene-debs-got-1-million-votes-president-as-convict-number-9653-Weber-161102\/\">campaigned as \u201cConvict No. 9653\u201d<\/a>\u00a0and earned about 3.4 percent of the popular vote.<\/p>\n<p>Former Texas Gov. Rick Perry\u00a0also ran for president\u00a0while under indictment, and conspiracist\u00a0Lyndon LaRouche and \u201cTiger King\u201d star\u00a0Joe Exotic\u00a0launched presidential bids after convictions.\u00a0<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Could_Trump_pardon_himself_if_reelected\"><\/span>Could Trump pardon himself if reelected?\u00a0<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Rozenshtein said the question of whether a president could pardon themselves is \u201chotly debated among scholars,\u201d but it\u2019s unclear who, if anyone, would have any say to challenge such action.\u00a0<\/p>\n<p>An <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.justice.gov\/file\/20856\/download\">August 1974 opinion<\/a> by the OLC contended that a president cannot pardon themselves under the \u201cfundamental rule that no one may be a judge in his own case.\u201d\u00a0\u00a0<\/p>\n<p>However, the DOJ office also argued that if the 25th Amendment was invoked \u2014 temporarily designating a vice president the acting president \u2014 the acting\u00a0president could pardon the elected president. After the fact, the elected president could resume the duties of his office, the office argued.\u00a0<\/p>\n<p>Still, that theory has never been tested in court, McQuade noted. Rozenshtein said that any such theories are speculative until they are tested.\u00a0<\/p>\n<p>\u201cThis is a class of questions that has no answer until some authoritative institution \u2014 specifically the Supreme Court \u2014 gives us an answer,\u201d he said.\u00a0<\/p>\n<\/div>\n<p>Copyright 2023 Nexstar Media Inc.
