{"id":586127,"date":"2023-08-08T02:00:00","date_gmt":"2023-08-07T23:00:00","guid":{"rendered":"https:\/\/en.buradabiliyorum.com\/trump-directs-rage-at-dc-judge-handling-his-jan-6-case\/"},"modified":"2023-08-08T02:00:00","modified_gmt":"2023-08-07T23:00:00","slug":"trump-directs-rage-at-dc-judge-handling-his-jan-6-case","status":"publish","type":"post","link":"https:\/\/buradabiliyorum.com\/en\/trump-directs-rage-at-dc-judge-handling-his-jan-6-case\/","title":{"rendered":"#Trump directs rage at DC judge handling his Jan. 6 case"},"content":{"rendered":"<p><img decoding=\"async\" src=\"https:\/\/thehill.com\/wp-content\/uploads\/sites\/2\/2023\/07\/AP23188739830623-e1688766176207.jpg?w=900\" \/><\/p>\n<div>\n<p>From the attorneys prosecuting his cases to his allies-turned-foes, few who have gone up against former President Trump have been spared his wrath.<\/p>\n<p>Now, in the days after his indictment over efforts to subvert the 2020 election results, Trump is directing his anger at a new target: U.S. District Judge Tanya Chutkan, who is\u00a0overseeing that case. \u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr1_ab\"><\/aside>\n<p>\u201cThere is no way I can get a fair trial with the judge \u2018assigned\u2019 to the ridiculous freedom of speech\/fair elections case,\u201d Trump wrote in all caps in a <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/truthsocial.com\/@realDonaldTrump\/posts\/110842897375935251\">Truth Social post Sunday<\/a>. \u201cEverybody knows this, and so does she!\u201d\u00a0<\/p>\n<p>Chutkan was randomly assigned to Trump\u2019s case after he was indicted last week on four charges. An Obama <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>ointee, Chutkan has given out tough sentences to Jan. 6 defendants, either matching or exceeding the sentences for which prosecutors asked. \u00a0<\/p>\n<p>She also previously denied a Trump lawsuit seeking to block the National Archives from turning over documents to the House Jan. 6 committee, writing that \u201cPresidents are not kings, and Plaintiff is not President.\u201d\u00a0<\/p>\n<p>Her role in Trump\u2019s Washington, D.C., case has placed her squarely in the former president\u2019s line of fire. Trump <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/truthsocial.com\/@realDonaldTrump\/posts\/110848362917019858\">has said on Truth Social<\/a> that his counsel plans to move to recuse Chutkan from the case, calling her \u201cthe Judge of [special counsel Jack Smith\u2019s] \u2018dreams.\u2019\u201d\u00a0<\/p>\n<p>While it\u2019s rare for a criminal defendant to \u201cgo out of their way\u201d to antagonize a judge, Trump\u2019s recent <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/social-mediaa\/\" data-internallinksmanager029f6b8e52c=\"1\" title=\"Social Media\" target=\"_blank\" rel=\"noopener\">social media<\/a> posts will likely not have meaningful bearing on the case, according to Bruce Green, director of the Louis Stein Center for Law and Ethics at Fordham University.\u00a0<\/p>\n<p>\u201cI don\u2019t think the judge will respond to his public statements, and I don\u2019t think she should,\u201d Green said. \u201cIf he wants to make a recusal motion and there\u2019s a nonfrivolous recusal motion to be made \u2026 he\u2019s entitled to make the motion if he wants to make it.\u201d\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr2_ab\"><\/aside>\n<p>\u201cHe has a First Amendment right, at the moment, to post things on social media,\u201d he added.\u00a0<\/p>\n<p>Taking his legal frustrations out on social media is not a new tactic for Trump, who\u00a0has questioned the motives of judges or legitimacy of court rulings\u00a0throughout his presidency and post-presidency.\u00a0<\/p>\n<p>Trump has taken aim at the judge overseeing the civil case involving the writer E. Jean Carroll, deriding him as a \u201cClinton-appointed judge.\u201d He also previously posted multiple times about Judge Juan Merchan, who is handling the former president\u2019s hush money case in Manhattan, referring to him as a \u201cTrump Hating Judge\u201d and claiming Merchan \u201cHATES ME.\u201d\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr3_ab\"><\/aside>\n<p>Previously, Trump lambasted the judge who oversaw the case of his 2016 campaign Chairman Paul Manafort, derided some jurists who ruled against him as \u201cObama judges\u201d and suggested a judge\u2019s Mexican heritage meant he was potentially biased against him.\u00a0<\/p>\n<p>The tactic appears to be one motivated by Trump\u2019s own issues with judges whom he perceives as biased, largely because of who appointed them, and it has typically been out of step with his own legal team.\u00a0<\/p>\n<p>David Sklansky, a Stanford Law professor and co-director of the university\u2019s Criminal Justice Center, said Chutkan is an \u201cexperienced judge\u201d unlikely to be fazed by Trump\u2019s comments. Suggestions she should be disqualified or made to recuse are \u201cridiculous,\u201d he said.\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr4_ab\"><\/aside>\n<p>\u201cThere\u2019s absolutely no basis for that,\u201d Sklansky said. \u201cI will be interested to see whether any of Trump\u2019s lawyers are willing to make that suggestion; it\u2019s such a crazy suggestion from a legal standpoint.\u201d\u00a0<\/p>\n<p>John Lauro, one of the attorneys representing Trump in the D.C. case, said on a podcast with Florida defense attorney David Markus that he is still assessing the potential for a motion to seek the judge\u2019s recusal.\u00a0<\/p>\n<p>\u201cI need to take a hard look at this issue from a legal perspective and want to make sure it is correctly and exhaustively analyzed. So, we\u2019ve made no final decision on that issue. It has to be really looked at with a fine-toothed comb. It raises a lot of issues,\u201d Lauro said.\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr5_ab\"><\/aside>\n<p>Lauro added that Trump\u2019s comments about Chutkan came from a \u201clayman\u2019s\u201d political perspective, referring to the fact that Chutkan was appointed to the bench by a Democratic president. Joe Tacopina, an attorney representing Trump in the New York hush money case, made similar remarks when Trump attacked Merchan\u2019s credibility. \u00a0<\/p>\n<p>But sometimes Trump\u2019s online attacks have escalated to real-life violence. Merchan and his family received death threats after Trump criticized him, and a bomb threat interrupted the start of proceedings in a $250 million civil litigation brought by New York\u2019s attorney <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/general\/\" data-internallinksmanager029f6b8e52c=\"3\" title=\"General\" target=\"_blank\" rel=\"noopener\">general<\/a> against the Trump Organization and Trump family, as The Hill previously reported.\u00a0<\/p>\n<p>\u201cTo the extent [Trump\u2019s comments] pose the risk of personal harm to the judge and others, they need to be dealt with forcefully,\u201d said Daniel Richman, a professor at Columbia University Law School.\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr6_ab\"><\/aside>\n<p>Jon Lewis,\u00a0a research fellow at the Program on Extremism at George Washington University, said Trump\u2019s social media attacks follow the same playbook as those ahead of the Capitol attack, where his posts were used as a motivating force for violence.\u00a0<\/p>\n<p>\u201cWe just spent the last two-plus years talking about the role of Trump as a social media amplifier, as a radicalizing figure, and how the playbook that we saw going into Jan. 6 had moved beyond just one individual,\u201d Lewis said. \u201cIt\u2019s this unique spot that Trump continues to sit in.\u201d\u00a0<\/p>\n<p>Though an event like Jan. 6 is unlikely to happen again as a result, \u201clone actors\u201d \u2014 such as the man who attempted to breach an Ohio FBI field office or the man who allegedly attacked former House Speaker Nancy Pelosi\u2019s (D-Calif.) husband \u2014 pose a real threat, Lewis added. \u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr7_ab\"><\/aside>\n<p>\u201cLone actors who see posts from politicians and prominent figures in this right-wing space as a call to arms are, to some extent, looking for an excuse to commit political violence against their enemies and are happy to seize upon these posts as their chance to do something,\u201d he said. \u00a0<\/p>\n<p>A defendant provoking violence could be ordered remanded by a judge ahead of trial, Green said.\u00a0<\/p>\n<p>\u201cIf a defendant is obstructing justice, destroying evidence, intimidating witnesses, provoking violence against witnesses \u2014 that defendant can land in jail prior to the trial,\u201d he said.\u00a0<\/p>\n<p>Keeping Trump in check without infringing on his right to free speech \u2014 all while the 2024 presidential election rages on \u2014 will be a \u201cdifficult issue\u201d for Chutkan to navigate, Sklansky said.\u00a0<\/p>\n<p>\u201cIt\u2019s going to be a work in progress,\u201d Sklansky said. \u201cThe trial judge needs to be concerned with preserving the fairness of the potential jury venire and ensuring that Trump and the prosecutors both can receive a fair hearing at trial. On the other hand, Trump does have First Amendment rights and he is running for president.\u201d\u00a0<\/p>\n<p>\u201cThe judge is not going to want to step on that,\u201d he said. \u201cShe\u2019s going to need to find a middle ground.\u201d\u00a0<\/p>\n<\/div>\n<p>Copyright 2023 Nexstar Media Inc.
