{"id":586244,"date":"2023-08-09T01:00:00","date_gmt":"2023-08-08T22:00:00","guid":{"rendered":"https:\/\/en.buradabiliyorum.com\/trump-faces-uphill-battle-in-moving-case-from-dc\/"},"modified":"2023-08-09T01:00:00","modified_gmt":"2023-08-08T22:00:00","slug":"trump-faces-uphill-battle-in-moving-case-from-dc","status":"publish","type":"post","link":"https:\/\/buradabiliyorum.com\/en\/trump-faces-uphill-battle-in-moving-case-from-dc\/","title":{"rendered":"#Trump faces uphill battle in moving case from DC"},"content":{"rendered":"<p><img decoding=\"async\" src=\"https:\/\/thehill.com\/wp-content\/uploads\/sites\/2\/2023\/08\/trumpdonald_080823_ap_robertbukaty.jpg?w=900\" \/><\/p>\n<div>\n<p>Legal experts have cast doubts that former President Trump and his legal team will succeed in attempting to move his case on Jan. 6 charges out of Washington, D.C., especially before jury selection is even conducted.<\/p>\n<p>Trump has floated the idea of moving his case to nearby West Virginia in the hopes he might face a more politically friendly crowd in a state he won in 2020 by more than 38 points.<\/p>\n<aside class=\"ad-unit ad-unit--mr1_ab\"><\/aside>\n<p>But judges have previously denied more than a dozen other Jan. 6 defendants\u2019 attempts to transfer their cases, including the judge who would rule on such a request in Trump\u2019s case.<\/p>\n<p>There is also D.C. Circuit Court precedent, dating back to the Watergate scandal, which deems it preferable to first conduct jury selection before concluding a fair jury cannot be selected for a case.<\/p>\n<p>\u201cNo way I can get a fair trial or even close to a fair trial, in Washington, D.C.,\u201d Trump wrote on Truth <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/social-mediaa\/\" data-internallinksmanager029f6b8e52c=\"1\" title=\"Social Media\" target=\"_blank\" rel=\"noopener\">Social<\/a> of the nation\u2019s capital, which he has often trashed.<\/p>\n<p>Trump pleaded not guilty last week to four federal charges stemming from his efforts to remain in power following the 2020 election. It is one of three indictments the former president faces, and a fourth could soon emerge in Georgia.<\/p>\n<p>Since the Jan. 6 indictment, Trump has lashed out at the judge, special counsel Jack Smith and the city itself.\u00a0<\/p>\n<p>Jimmy Gurul\u00e9, a Notre Dame Law School professor and former federal prosecutor, said an attempt by Trump to transfer the venue would be frivolous.<\/p>\n<aside class=\"ad-unit ad-unit--mr2_ab\"><\/aside>\n<p>\u201cThere has to be compelling evidence that the defendant cannot receive a fair trial,\u201d Gurul\u00e9 said. \u201cThat\u2019s the justification, whether or not the defendant can receive a fair trial. And at this point, there\u2019s no compelling evidence whatsoever that Trump cannot receive, that there cannot be impaneled 12 impartial jurors to preside over the case.\u201d<\/p>\n<p>Trump and his attorneys have previewed multiple arguments for transferring the venue.<\/p>\n<p>The former president has referenced the heavily Democratic skew of D.C. voters, arguing the city is \u201cover 95% anti-Trump,\u201d a likely reference to the near percentage of D.C. voters who cast a ballot for President Biden in 2020.<\/p>\n<aside class=\"ad-unit ad-unit--mr3_ab\"><\/aside>\n<p>The District is more than 75 percent registered Democrat.\u00a0<\/p>\n<p>U.S. District Judge Tanya Chutkan, an Obama <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>ointee who is assigned to oversee Trump\u2019s case, in April 2022 denied another Jan. 6 defendant\u2019s attempt to move his case on similar grounds.<\/p>\n<p>The defendant had noted the Capitol riot\u2019s impact on local residents, pretrial publicity and how D.C. voted in the 2020 presidential election.<\/p>\n<aside class=\"ad-unit ad-unit--mr4_ab\"><\/aside>\n<p>Chutkan rejected all of those arguments, calling the defendant\u2019s contention about the city\u2019s political makeup \u201cmisleading and ultimately unavailing.\u201d<\/p>\n<p>\u201cHe does not indicate what percentage of District residents actually voted in the 2020 election, so his emphasis on voters excludes many potential jurors who may not closely follow politics,\u201d Chutkan wrote.<\/p>\n<p>She also wrote, \u201cIn any event, Defendant\u2019s assumptions concerning party affiliation in the District are not an appropriate basis for changing venue. Jurors\u2019 political leanings are not, by themselves, evidence that those jurors cannot fairly and impartially consider the evidence presented and apply the law as instructed by the court.\u201d<\/p>\n<aside class=\"ad-unit ad-unit--mr5_ab\"><\/aside>\n<p>Trump has also suggested a transfer is necessary because he has called for a federal takeover of the nation\u2019s capital. Trump has repeatedly attacked the city, including when Trump said he had seen \u201cthe filth and the decay\u201d of D.C. when <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/trip-and-travel\/\" data-internallinksmanager029f6b8e52c=\"10\" title=\"Trip &amp; Travel\" target=\"_blank\" rel=\"noopener\">travel<\/a>ing to his arraignment last week.<\/p>\n<p>\u201cThe goal may be that if Trump says \u2014 \u2018If I say enough bad things about people who live in Washington, D.C., then maybe I\u2019ll create a situation in which I can\u2019t get a fair trial.\u2019 But Washington, D.C., is a major city; there are lots of people there. I don\u2019t think there\u2019s going to be any difficulty finding a fair-minded jury in [D.C.], and I think there\u2019s little-to-no chance that Trump will be able to convince a judge of that,\u201d said David Sklansky, a Stanford Law professor and co-director of the university\u2019s Criminal Justice Center.<\/p>\n<p>Trump attorney John Lauro during an appearance on CBS\u2019s \u201cFace the Nation\u201d on Sunday suggested that West Virginia would instead be an \u201cexcellent venue\u201d to try the case.<\/p>\n<aside class=\"ad-unit ad-unit--mr6_ab\"><\/aside>\n<p>\u201cWe would like a diverse venue, a diverse jury. One that reflects the characteristics of the American people,\u201d Lauro said.<\/p>\n<p>Lauro did not return a request for comment.<\/p>\n<p>Trump won West Virginia by more than 38 percentage points in 2020, one of his largest victories in any state.<\/p>\n<aside class=\"ad-unit ad-unit--mr7_ab\"><\/aside>\n<p>Bradley Moss, a national security lawyer, agreed it was unlikely a transfer to West Virginia \u2014 or anywhere else \u2014 would succeed.<\/p>\n<p>\u201cThe suggestion of moving the case to West Virginia is ludicrous and exposes this all as a political talking point, not serious legal arguments,\u201d Moss said. \u201cD.C. is far more demographically diverse than West Virginia. The one thing West Virginia does have is that it heavily favored Mr. Trump, which, of course, is the real point of this idea. No part of this case is attached to West Virginia.\u201d<\/p>\n<p>Judges have sparingly granted transfer motions in past high-profile criminal prosecutions. Boston Marathon bomber Dzhokhar Tsarnaev\u2019s efforts to move his case out of Boston were denied, and Enron CEO Jeffrey Skilling was unable to transfer his criminal case out of the Houston area.<\/p>\n<p>Skilling\u2019s effort went all the way to the Supreme Court in 2010. The court ruled that the publicity surrounding Skilling\u2019s case did not prevent him from obtaining a fair trial. But the opinion noted a transfer to a different district \u201cif extraordinary local prejudice will prevent a fair trial\u201d is \u201ca basic requirement of due process.\u201d\u00a0<\/p>\n<p>\u201cIt is simply not realistic to believe Mr. Trump can meet the \u2018extraordinary local prejudice\u2019 standard for transferring the case, at least based on his current evidence, and even with his repeated efforts to politically smear the city in an effort to inflame potential jurors\u2019 passions,\u201d said Moss.\u00a0<\/p>\n<p>Binding D.C. Circuit precedent also provides that it is preferable to first attempt jury selection before transferring a case, meaning Trump\u2019s best chance at succeeding may not come until down the road. The precedent <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/law.justia.com\/cases\/federal\/appellate-courts\/cadc\/4104248\/559-f2d-31.html\">originates from the criminal case<\/a> of H.R. \u201cBob\u201d Haldeman, Nixon\u2019s chief of staff who was prosecuted in connection with the Watergate scandal.<\/p>\n<p>Chutkan noted the case in ruling on the transfer motion last year.<\/p>\n<p>\u201cIn any U.S. jurisdiction, most prospective jurors will have heard about the events of January 6, and many will have various disqualifying biases. The appropriate way to identify and address those biases is through careful voir dire,\u201d Chutkan wrote, referring to the Latin term for questioning potential jurors\u2019 fitness during jury selection.<\/p>\n<p><em>Ella Lee contributed.<\/em><\/p>\n<\/div>\n<p>Copyright 2023 Nexstar Media Inc.
