{"id":586623,"date":"2023-08-11T20:56:37","date_gmt":"2023-08-11T17:56:37","guid":{"rendered":"https:\/\/en.buradabiliyorum.com\/doj-moves-to-dismiss-hunter-biden-case-to-bring-new-charges\/"},"modified":"2023-08-11T20:56:37","modified_gmt":"2023-08-11T17:56:37","slug":"doj-moves-to-dismiss-hunter-biden-case-to-bring-new-charges","status":"publish","type":"post","link":"https:\/\/buradabiliyorum.com\/en\/doj-moves-to-dismiss-hunter-biden-case-to-bring-new-charges\/","title":{"rendered":"#DOJ moves to dismiss Hunter Biden case to bring new charges"},"content":{"rendered":"<p><img decoding=\"async\" src=\"https:\/\/thehill.com\/wp-content\/uploads\/sites\/2\/2023\/08\/AP23223646954550-e1691788628809.jpg?w=900\" \/><\/p>\n<div>\n<p>Prosecutors investigating Hunter Biden on tax-related charges say a trial is imminent after plea deal negotiations fell apart last month.<\/p>\n<p>David Weiss, the U.S. attorney leading the investigation moved to dismiss the case against Biden in new court filings so prosecutors can bring charges in Washington, D.C., or California. <\/p>\n<aside class=\"ad-unit ad-unit--mr1_ab\"><\/aside>\n<p>The president\u2019s son was set to agree to plead guilty to two tax offenses and enter a pretrial diversion program on a gun charge, allowing him to avoid a formal charge under specific conditions. <\/p>\n<p>But the deal crumbled after a hearing last month when a Delaware district judge put off accepting the complex deal negotiated by Biden and the DOJ.<\/p>\n<p>\u201cAfter the hearing, the parties continued negotiating but reached an impasse,\u201d Weiss wrote in Friday court filings. \u201cA trial is therefore in order.\u201d<\/p>\n<p>After the hearing last month, both parties were directed to submit in writing their responses to Judge Maryellen Noreika\u2019s concerns. On Friday, the Justice Department asked Noreika to set aside those briefing deadlines.\u00a0<\/p>\n<p>\u201cThe Court\u2019s briefing order is premised on the idea that the parties intend to continue towards a guilty plea in Criminal Action No. 23-mj-00274 and diversion in Criminal Action No. 23-cr-00061,\u201d prosecutors wrote.\u00a0<\/p>\n<p>\u201cBut that is no longer the case,\u201d they said. \u201cFollowing additional negotiations after the hearing held on July 26, 2023, the parties are at an impasse and are not in agreement on either a plea agreement or a diversion agreement. Therefore, the Government believes the Court\u2019s briefing order should be vacated.\u201d<\/p>\n<aside class=\"ad-unit ad-unit--mr2_ab\"><\/aside>\n<p>Weiss was on Friday <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>ointed as a special counsel to continue investigating Biden. Special counsels have more powers than U.S. attorneys.<\/p>\n<p>U.S. Attorney <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/general\/\" data-internallinksmanager029f6b8e52c=\"3\" title=\"General\" target=\"_blank\" rel=\"noopener\">General<\/a> Merrick Garland said in a statement Friday that Weiss advised him that the investigation had \u201creached a stage\u201d where he believed he should continue his work as a special counsel and asked to be appointed. <\/p>\n<p>\u201cUpon considering his request, as well as the extraordinary circumstances relating to this matter, I have concluded that it is in the public interest to appoint him as special counsel,\u201d Garland said. <\/p>\n<aside class=\"ad-unit ad-unit--mr3_ab\"><\/aside>\n<p>Noreika ordered Biden\u2019s attorneys to respond to the government\u2019s motion by noon Monday.<\/p>\n<\/div>\n<p>Copyright 2023 Nexstar <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/social-mediaa\/\" data-internallinksmanager029f6b8e52c=\"1\" title=\"Social Media\" target=\"_blank\" rel=\"noopener\">Media<\/a> Inc.
