{"id":586703,"date":"2023-08-12T13:00:00","date_gmt":"2023-08-12T10:00:00","guid":{"rendered":"https:\/\/en.buradabiliyorum.com\/legal-chaos-engulfs-biden-and-trump\/"},"modified":"2023-08-12T13:00:00","modified_gmt":"2023-08-12T10:00:00","slug":"legal-chaos-engulfs-biden-and-trump","status":"publish","type":"post","link":"https:\/\/buradabiliyorum.com\/en\/legal-chaos-engulfs-biden-and-trump\/","title":{"rendered":"#Legal chaos engulfs Biden and Trump"},"content":{"rendered":"<p><img decoding=\"async\" src=\"https:\/\/thehill.com\/wp-content\/uploads\/sites\/2\/2023\/08\/trumpdonald_080323ap_memo-trump-courts.jpg?w=900\" \/><\/p>\n<div>\n<p>A dramatic day in Washington<strong>\u00a0<\/strong>on<strong>\u00a0<\/strong>Friday shook up the 2024 presidential race, causing big problems for President Biden and former President Trump.<\/p>\n<p>The more shocking development came when Attorney <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/general\/\" data-internallinksmanager029f6b8e52c=\"3\" title=\"General\" target=\"_blank\" rel=\"noopener\">General<\/a> Merrick Garland announced the <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>ointment of a special counsel to investigate the president\u2019s son, Hunter Biden. The special counsel will be David Weiss, who had already been the lead prosecutor on the matter but with more circumscribed powers.<\/p>\n<aside class=\"ad-unit ad-unit--mr1_ab\"><\/aside>\n<p>Relatedly, negotiations about a plea deal for the younger Biden over a failure to pay taxes and a gun matter definitively broke down. A deal had seemed to be sealed in June but then crumbled during a court appearance in late July. The chances of the deal being resurrected were extinguished on Friday.\u00a0<\/p>\n<p>Shortly before all that, and less than a mile away, the judge in the most recent of Trump\u2019s three criminal cases imposed restrictions on what the former president can say and how he can use evidence unveiled in the recovery process.<\/p>\n<p>Judge Tanya Chutkan, who is presiding over the case pertaining to Trump\u2019s attempts to overturn the 2020 election, said that any attempt to \u201cintimidate witnesses or prejudice potential jurors\u201d would draw action from her.\u00a0Chutkan asserted that Trump would not be able to share \u201csensitive\u201d evidence in the case with the public.<\/p>\n<p>Trump is charged with four crimes in the matter. He has also been indicted on 40 criminal counts pertaining to sensitive documents kept at Mar-a-Lago and 34 counts of falsifying business records in New York.\u00a0He has pleaded not guilty to all charges.<\/p>\n<p>The upshot of the two legal developments is stark for the frontrunners in the 2024 battle for the White House.<\/p>\n<p>For Biden, he now confronts the reality that his son\u2019s behavior \u2014 much of it tawdry or shady at a minimum \u2014 will continue to be an issue into the 2024 election year. That\u2019s a problem Biden doesn\u2019t need to have,\u00a0given that he is already contending with low approval ratings and concerns about his status as the oldest president ever.<\/p>\n<aside class=\"ad-unit ad-unit--mr2_ab\"><\/aside>\n<p>Democrats express concern,\u00a0even if the White House resolutely seeks to maintain a perception of its separation from the case.<\/p>\n<p>\u201cThis is pretty bad,\u201d said one Democratic strategist granted anonymity to speak candidly. \u201cAny notion that this was going away before the election is basically gone, any notion\u00a0that this was an isolated issue that would only affect Hunter Biden is gone, any notion that this is not going to bleed into the election and be a serious problem is gone.\u201d<\/p>\n<p>Trump, for his part, faces multifaceted dangers. The former president\u2019s ultra-combative approach could land him in legal trouble with Judge Chutkan, especially if he goes after former Vice President\u00a0Pence, who wears two hats as both a GOP rival to Trump and a potential witness at trial in the 2020 election case.<\/p>\n<aside class=\"ad-unit ad-unit--mr3_ab\"><\/aside>\n<p>Trump\u2019s broader tendency toward bellicosity \u2014 seen again last Friday, when he warned on <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/social-mediaa\/\" data-internallinksmanager029f6b8e52c=\"1\" title=\"Social Media\" target=\"_blank\" rel=\"noopener\">social media<\/a> \u201cIf you go after me, I\u2019m coming after you\u201d \u2014 also holds its perils. The Truth Social posting was cited in a filing by prosecutors and, one week later, Chutkan warned specifically against \u201cinflammatory statements.\u201d<\/p>\n<p>Chutkan also suggested that misbehavior could lead her to move more speedily to trial if there\u00a0were\u00a0a risk of jury-pool contamination.<\/p>\n<p>The widespread assumption is that Trump and his team want to extend the legal process past the date in January\u00a02025\u00a0when he would be inaugurated again if he won the presidency \u2014 something\u00a0that\u00a0would enable him to discontinue any federal cases against him.<\/p>\n<aside class=\"ad-unit ad-unit--mr4_ab\"><\/aside>\n<p>On the other hand, if Trump submits to Chutkan\u2019s warnings, it could make him look more cowed than his supporters are accustomed to seeing. It could also lower the decibels of his attacks on the rest of the GOP primary field.<\/p>\n<p>At Friday\u2019s hearing, Trump lawyer John Lauro claimed the former president had the right to speak out about things he remembers while \u201con the campaign trail.\u201d<\/p>\n<p>Chutkan shot back:\u00a0\u201cThe existence of a political campaign will not have any bearing on my decision.\u201d<\/p>\n<aside class=\"ad-unit ad-unit--mr5_ab\"><\/aside>\n<p>Some former Trump allies seem highly doubtful that he can stop himself from transgressing the limits Chutkan has set.<\/p>\n<p>\u201cTrump is going to have his bail revoked,\u201d Anthony Scaramucci wrote on X, the social platform formerly known as Twitter, Friday afternoon. Scaramucci served an infamously brief spell as Trump\u2019s White House Communications Director in 2017.<\/p>\n<p>Meanwhile, on the Biden matter, Republicans have hit out at the appointment of Weiss as special counsel. The most vigorous critics of the president contend that Weiss pulled his punches at an earlier stage of the probe.<\/p>\n<aside class=\"ad-unit ad-unit--mr6_ab\"><\/aside>\n<p>They also note that an IRS whistleblower, Gary Shapley, previously testified that Weiss had wanted special counsel powers and been unable to get them. Weiss denies this.<\/p>\n<p>A spokesman for House Judiciary Committee Chairman Jim Jordan (R-Ohio) asserted Friday that Weiss \u201ccan\u2019t be trusted.\u201d House Oversight Committee Chairman James Comer (R-Ky.) alleged that the appointment was part of \u201cthe Justice Department\u2019s efforts to attempt a Biden family coverup.\u201d<\/p>\n<p>At a minimum, Republicans see some measure of validation in the appointment as well, however.<\/p>\n<aside class=\"ad-unit ad-unit--mr7_ab\"><\/aside>\n<p>\u201cIt adds jet fuel to the fire of the crisis the Biden White House is having to manage,\u201d GOP strategist Ron Bonjean told this column. \u201cIt looks to voters like an admission that where there is smoke there could be some fire.\u201d<\/p>\n<p>No concrete evidence of wrongdoing by the president has emerged, while the White House has asserted he was never in business with his son.<\/p>\n<p>But the bottom line is that Friday added one more thing for both Biden and Trump to fend off\u2014 just as they begin to square up for a likely 2024 rematch.<\/p>\n<p><em>The Memo is a reported column by Niall Stanage<\/em>.<\/p>\n<\/div>\n<p>Copyright 2023 Nexstar Media Inc.
