The stakes are huge for American taxpayers and patients. Medicare enrollees taking the 10 selected drugs paid\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/urldefense.com\/v3\/__https:\/www.hhs.gov\/about\/news\/2023\/08\/29\/hhs-selects-the-first-drugs-for-medicare-drug-price-negotiation.html__;!!IKRxdwAv5BmarQ!fIqCtEHXWD3wRalwlR2rBfTubSzGwu-4zmuJOl5sMoIxcgHLX_hefVodXbHZGgVQAkE8PMUTdAt_9Bnwhrg%24\">$3.4 billion<\/a>\u00a0in out-of-pocket costs in 2022. These 10 drugs cost Medicare\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/urldefense.com\/v3\/__https:\/www.hhs.gov\/about\/news\/2023\/08\/29\/hhs-selects-the-first-drugs-for-medicare-drug-price-negotiation.html__;!!IKRxdwAv5BmarQ!fIqCtEHXWD3wRalwlR2rBfTubSzGwu-4zmuJOl5sMoIxcgHLX_hefVodXbHZGgVQAkE8PMUTdAt_9Bnwhrg%24\">$50.5 billion<\/a>\u00a0between June 1, 2022 and May 31, 2023.\u00a0\u00a0<\/p>\n<p>For President Biden, lowering drug prices is a signature issue, especially approaching the 2024 election. And lower drug prices are hugely popular across party lines. More than 3 in 4 Americans think the costs of pre<a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">script<\/a>ion drugs are<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/urldefense.com\/v3\/__https:\/www.kff.org\/health-costs\/poll-finding\/public-opinion-on-prescription-drugs-and-their-prices\/__;!!IKRxdwAv5BmarQ!fIqCtEHXWD3wRalwlR2rBfTubSzGwu-4zmuJOl5sMoIxcgHLX_hefVodXbHZGgVQAkE8PMUTdAt_r0OFAbk%24\">\u00a0unaffordable<\/a>\u00a0and nearly 1 in 3 say they haven\u2019t taken their medications as prescribed due to cost.\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr1_ab\"><\/aside>\n<p>Yet the stakes are equally high for pharmaceutical companies, involving some of their most lucrative blockbuster drugs to treat blood clots (<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/urldefense.com\/v3\/__https:\/www.eliquis.bmscustomerconnect.com\/__;!!IKRxdwAv5BmarQ!fIqCtEHXWD3wRalwlR2rBfTubSzGwu-4zmuJOl5sMoIxcgHLX_hefVodXbHZGgVQAkE8PMUTdAt_nyeT5Ow%24\">Eliquis<\/a>\u00a0and\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/urldefense.com\/v3\/__https:\/www.xarelto-us.com\/__;!!IKRxdwAv5BmarQ!fIqCtEHXWD3wRalwlR2rBfTubSzGwu-4zmuJOl5sMoIxcgHLX_hefVodXbHZGgVQAkE8PMUTdAt_16dV6qM%24\">Xarelto<\/a>) and diabetes (<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/urldefense.com\/v3\/__https:\/www.jardiance.com\/__;!!IKRxdwAv5BmarQ!fIqCtEHXWD3wRalwlR2rBfTubSzGwu-4zmuJOl5sMoIxcgHLX_hefVodXbHZGgVQAkE8PMUTdAt_0mXEgtw%24\">Jardiance<\/a>\u00a0and\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/urldefense.com\/v3\/__https:\/www.januvia.com\/__;!!IKRxdwAv5BmarQ!fIqCtEHXWD3wRalwlR2rBfTubSzGwu-4zmuJOl5sMoIxcgHLX_hefVodXbHZGgVQAkE8PMUTdAt_b7nOqUw%24\">Januvia<\/a>), as well as drugs for cardiovascular disease and cancer. The industry will figuratively go to war to defend the right to set drug prices. Already the battle lines have been forged, with drug companies bringing multiple\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/urldefense.com\/v3\/__https:\/www.reuters.com\/legal\/court-challenges-medicare-drug-price-negotiation-plan-2023-08-29\/__;!!IKRxdwAv5BmarQ!fIqCtEHXWD3wRalwlR2rBfTubSzGwu-4zmuJOl5sMoIxcgHLX_hefVodXbHZGgVQAkE8PMUTdAt_E2XvmbE%24\">legal challenges<\/a>\u00a0across the country. The issue is highly likely to reach a conservative Supreme Court that has shown hostility to federal agencies trying to do big things for the American public.\u00a0\u00a0\u00a0<\/p>\n<p>Outcomes of current litigation rest on the\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/urldefense.com\/v3\/__https:\/www.congress.gov\/bill\/117th-congress\/house-bill\/5376\/text__;!!IKRxdwAv5BmarQ!fIqCtEHXWD3wRalwlR2rBfTubSzGwu-4zmuJOl5sMoIxcgHLX_hefVodXbHZGgVQAkE8PMUTdAt_n3fu9uA%24\">Inflation Reduction Act<\/a>\u00a0of 2022, which for the first time in history granted the Centers for Medicare &amp; Medicaid Services the power to negotiate drug prices, starting with these 10 drugs. Dozens more drugs will be added over time. CMS spent months formulating<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/urldefense.com\/v3\/__https:\/www.cms.gov\/files\/document\/revised-medicare-drug-price-negotiation-program-guidance-june-2023.pdf__;!!IKRxdwAv5BmarQ!fIqCtEHXWD3wRalwlR2rBfTubSzGwu-4zmuJOl5sMoIxcgHLX_hefVodXbHZGgVQAkE8PMUTdAt_eEXmYuM%24\">\u00a0regulations<\/a>\u00a0requiring drug manufacturers to negotiate fair prices. And if price negotiations fail, Congress gave the agency the power to set a fair price, which companies have to abide by if they want to participate in Medicare.\u00a0<\/p>\n<p>CMS is, in effect, requiring companies to fairly negotiate reasonable prices or face exorbitant taxes and fines. A drug company can opt-out, refusing to sell any of its drugs to CMS if they do not agree to negotiations. Yet companies will be loath to walk away from such a generous government entitlement program whose payments for prescription drugs often constitute a lion\u2019s share of their profits. Pharmaceutical manufacturers already stand to lose in excess of<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/urldefense.com\/v3\/__https:\/www.reuters.com\/legal\/drugmakers-set-strategy-legal-fight-against-us-pricing-regulation-2023-05-09\/__;!!IKRxdwAv5BmarQ!fIqCtEHXWD3wRalwlR2rBfTubSzGwu-4zmuJOl5sMoIxcgHLX_hefVodXbHZGgVQAkE8PMUTdAt_YBJtgZA%24\">\u00a0$25 billion<\/a>\u00a0in profits by 2031 via administration of CMS\u2019 program.\u00a0\u00a0\u00a0<\/p>\n<p>Rather than walking away, the industry has launched a\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/urldefense.com\/v3\/__https:\/www.reuters.com\/legal\/court-challenges-medicare-drug-price-negotiation-plan-2023-08-29\/__;!!IKRxdwAv5BmarQ!fIqCtEHXWD3wRalwlR2rBfTubSzGwu-4zmuJOl5sMoIxcgHLX_hefVodXbHZGgVQAkE8PMUTdAt_E2XvmbE%24\">blizzard of cases<\/a>\u00a0across the country, with more likely on the way. Most of their arguments rest on constitutional grounds, but the industry is also raising administrative law claims, arguing that CMS exceeded its authority or that Congress did not properly delegate power to the agency.\u00a0<\/p>\n<p>The gist of their arguments is that CMS wrested control of drug prices without sufficient authorization from Congress and to the detriment of manufacturers. The claim ultimately that consumers may be harmed by a lack access to future drug innovations. They further argue that they are being compelled to say something with which they do not agree \u2014 that the negotiated price of the drug is \u201cfair.\u201d Finally, they argue that the government is \u201c<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.cnn.com\/2023\/08\/29\/politics\/medicare-drug-price-negotiations\/index.html\">taking<\/a>\u201d their property without just compensation.\u00a0\u00a0<\/p>\n<p>To us, the industry\u2019s arguments look weak. It\u2019s not like drug manufacturers have not had to wrangle with federal agencies over drug prices before. For decades the Veterans Administration has\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/urldefense.com\/v3\/__https:\/www.va.gov\/opal\/nac\/fss\/pharmprices.asp__;!!IKRxdwAv5BmarQ!fIqCtEHXWD3wRalwlR2rBfTubSzGwu-4zmuJOl5sMoIxcgHLX_hefVodXbHZGgVQAkE8PMUTdAt_HNPYhPM%24\">negotiated<\/a>\u00a0drug prices with the industry. Congress clearly detailed CMS\u2019 authority in the Inflation Reduction Act to negotiate the price that Medicare will pay for a drug.\u00a0\u00a0It\u2019s hard to argue against it, although the industry is trying.<\/p>\n<aside class=\"ad-unit ad-unit--mr2_ab\"><\/aside>\n<p>Drug manufacturers\u2019 litigation strategy is nakedly transparent. Bring a bevy of cases across the country, harness a well-worn <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/watch-movies-tv-seriess\/\" data-internallinksmanager029f6b8e52c=\"8\" title=\"Watch Movies &amp; TV Series\" target=\"_blank\" rel=\"noopener\">series<\/a> of conservative legal claims, seek split judicial decisions and force the Supreme Court to step in with hope \u2014 even expectation \u2013 that its conservative supermajority lends a sympathetic ear.\u00a0\u00a0<\/p>\n<p>Let\u2019s remember that the U.S.<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/urldefense.com\/v3\/__https:\/www.healthsystemtracker.org\/chart-collection\/how-do-prescription-drug-costs-in-the-united-states-compare-to-other-countries\/*Per*20capita*20prescribed*20medicine*20spending,*20U.S.*20dollars,*202004-2019__;IyUlJSUlJSU!!IKRxdwAv5BmarQ!fIqCtEHXWD3wRalwlR2rBfTubSzGwu-4zmuJOl5sMoIxcgHLX_hefVodXbHZGgVQAkE8PMUTdAt_wnZCdgw%24\">\u00a0spends on average twice as much on prescription drugs<\/a>\u00a0as our peer nations. In 2019 (the latest year for which data are available), the U.S. spent $1,126 per capita on prescribed medicines, while comparable countries spent $552 on average. Per capita, prescribed medicine spending in the U.S. grew on average by 69 percent from 2004 to 2019, compared to 41 percent in comparable countries.\u00a0<\/p>\n<p>How do other countries save so much more than us in drug costs? A major reason is that they negotiate drug prices or set a limit on how much the government will spend on health care. Like other countries, CMS has incredible bargaining power as a major drug purchaser. It anticipates driving down the price of prescription drugs for tens of millions of beneficiaries, just as it did for\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/urldefense.com\/v3\/__https:\/aspe.hhs.gov\/reports\/insulin-affordability-ira-data-point__;!!IKRxdwAv5BmarQ!fIqCtEHXWD3wRalwlR2rBfTubSzGwu-4zmuJOl5sMoIxcgHLX_hefVodXbHZGgVQAkE8PMUTdAt_YtJJy2I%24\">insulin<\/a>\u00a0earlier this year.\u00a0\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr3_ab\"><\/aside>\n<p>In essence, U.S. taxpayers and mostly elderly patients are subsidizing lower prescription drug prices in other countries. Industry reliance on outsized profits in America enables it to sell the same drugs to other countries at far lower prices. This is unfair and unsustainable, and has been for decades. Congress agreed when it enacted the Inflation Reduction Act. Courts have no justification for substituting their opinions for that of the elected branches of government against weak constitutional arguments.\u00a0<\/p>\n<p>Most Americans, and virtually all health policy experts we know, feel passionately about lowering drug prices. For President Biden, winning that battle will likely have to go through the Supreme Court.\u00a0\u00a0<\/p>\n<p><em>Lawrence O.
