MAKE AMERICA GREAT AGAIN!\u201d he continued.<\/p>\n<p>Some legal experts have argued that Trump may not be qualified to run for president under Section 3 of the 14th Amendment, which states that no one who has \u201cengaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof.\u201d<\/p>\n<p>A growing number of Democrats and legal experts say the actions he allegedly took on Jan. 6, 2021, fall under either engaging in an insurrection against the Constitution or assisting others. Activist groups are also pushing\u00a0to disqualify Trump\u00a0from the ballot in key states, citing the 14th Amendment.<\/p>\n<p>Sen. Tim Kaine (D-Va.) and Rep. Adam Schiff (D-Calif.) both said Sunday that the 14th Amendment may disqualify Trump from the election. Kaine, on ABC\u2019s \u201cThis Week,\u201d said it may have been\u00a0\u201cmore productive\u201d to issue a declaration\u00a0about the 14th Amendment instead of pursuing a second impeachment against the former president after the Jan. 6, 2021, attack on the Capitol.<\/p>\n<p>\u201cIn my view, the attack on the Capitol that day was designed for a particular purpose at a particular moment,\u201d Kaine said. \u201cAnd that was to disrupt the peaceful transfer of power as laid out in the Constitution. So I think there\u2019s a powerful argument to be made. My sense is it\u2019s probably going to get resolved in the courts.\u201d<\/p>\n<p>Schiff said Sunday on MSNBC\u2019s \u201cInside with Jen Psaki,\u201d that the argument some legal experts are making relating to Trump\u2019s qualifications\u00a0is \u201cvalid,\u201d\u00a0noting that it does not matter whether a candidate has been convicted of insurrection, just that they have \u201cengaged in these acts.\u201d<\/p>\n<aside class=\"ad-unit ad-unit--mr2_ab\"><\/aside>\n<p>\u201cIt\u2019s a disqualification from holding office again, and it fits Donald Trump to a T,\u201d Schiff said.<\/p>\n<p>GOP presidential candidate Asa Hutchinson has also said the former president\u2019s alleged actions on Jan. 6 likely\u00a0violated the amendment, making him disqualified from becoming president.<\/p>\n<\/div>\n<p>Copyright 2023 Nexstar Media Inc.
