{"id":590889,"date":"2023-09-12T19:37:57","date_gmt":"2023-09-12T16:37:57","guid":{"rendered":"https:\/\/en.buradabiliyorum.com\/second-14th-amendment-challenge-to-trump-candidacy-filed-in-minnesota\/"},"modified":"2023-09-12T19:37:57","modified_gmt":"2023-09-12T16:37:57","slug":"second-14th-amendment-challenge-to-trump-candidacy-filed-in-minnesota","status":"publish","type":"post","link":"https:\/\/buradabiliyorum.com\/en\/second-14th-amendment-challenge-to-trump-candidacy-filed-in-minnesota\/","title":{"rendered":"#Second 14th Amendment challenge to Trump candidacy filed in Minnesota"},"content":{"rendered":"<p><img decoding=\"async\" src=\"https:\/\/thehill.com\/wp-content\/uploads\/sites\/2\/2023\/09\/trumpdonald_090823getty_press.jpg?w=900\" \/><\/p>\n<div>\n<p>A second lawsuit has been filed to keep former President Trump off the ballot in 2024, this time by a liberal group seeking to do so in Minnesota citing the 14th Amendment. <\/p>\n<p><a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/freespeechforpeople.org\/wp-content\/uploads\/2023\/09\/2023-09-12-petition.pdf\">The suit<\/a>, filed by Free Speech For People in Minnesota\u2019s Supreme Court, echoes similar arguments made by some legal scholars and lawmakers who maintain that Trump should be disqualified from the ballot under the 14<sup>th<\/sup>\u00a0Amendment for his actions in connection to the Jan. 6, 2021, insurrection at the Capitol.\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr1_ab\"><\/aside>\n<p>Section 3 of the amendment, which is cited in the lawsuit, states that no person shall hold elected office who \u201cengaged in insurrection or rebellion against the United States.\u201d<\/p>\n<p>Trump\u2019s actions leading up to and on Jan. 6, when a mob of his supporters stormed the Capitol in an effort to stop Congress\u2019 official Electoral College count of the 2020 election affirming President Biden\u2019s victory, was referred to the Justice Department by a select House panel late last year. The committee\u2019s investigation spanned months and included witness testimony from dozens of Trump White House officials at the time.<\/p>\n<p>Trump was later indicted by the Justice Department and in Georgia for efforts by him and his allies to overturn the 2020 election results and remain in power.<\/p>\n<p>In its letter to Minnesota Secretary of State Steven Simon (D), the group asked Simon to exclude Trump from the ballot. <\/p>\n<p>Simon said <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.sos.state.mn.us\/about-the-office\/news-room\/sec-steve-simon-statement-on-determining-eligibility-for-presidential-candidates\/\">in a statement<\/a> earlier this month that his office had gotten hundreds of calls, emails and letters regarding \u201ca legal argument that the 14th Amendment to the U.S. Constitution calls into question the eligibility of former President Donald Trump to run for office again,\u201d and made note that his office has no authority to investigate a candidate\u2019s eligibility. He added, however, that eligibility could be challenged in court.<\/p>\n<p>Laying out several allegations about Trump\u2019s actions leading up to, during and after the riot, the suit points out that the former president, who is a leading 2024 contender, \u201cremains unrepentant and would do it again.\u201d\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr2_ab\"><\/aside>\n<p>\u201cTo this day, Trump has never expressed regret that his supporters violently attacked the U.S. Capitol, threatened to assassinate the Vice President and other key leaders, and obstructed congressional certification of the electoral votes. Nor has he condemned any of them for these actions,\u201d the suit reads.<\/p>\n<p>A Washington D.C.-based watchdog group\u00a0filed a similar suit\u00a0to block Trump from the 2024 ballot in Colorado.\u00a0<\/p>\n<p>Earlier Tuesday, a group of New Hampshire lawmakers pressed the Granite State\u2019s secretary of state to reject any ongoing attempts to keep Trump off the ballot, calling the argument\u00a0an \u201cabsurd conspiracy theory.\u201d\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr3_ab\"><\/aside>\n<p>Section 3 of the amendment has rarely been used since the period im<a href=\"https:\/\/buradabiliyorum.com\/en\/category\/social-mediaa\/\" data-internallinksmanager029f6b8e52c=\"1\" title=\"Social Media\" target=\"_blank\" rel=\"noopener\">media<\/a>tely following the Civil War.<\/p>\n<\/div>\n<p>Copyright 2023 Nexstar Media Inc.
