{"id":591243,"date":"2023-09-15T04:54:58","date_gmt":"2023-09-15T01:54:58","guid":{"rendered":"https:\/\/en.buradabiliyorum.com\/ftc-warns-drugmakers-against-improper-patent-filings\/"},"modified":"2023-09-15T04:54:58","modified_gmt":"2023-09-15T01:54:58","slug":"ftc-warns-drugmakers-against-improper-patent-filings","status":"publish","type":"post","link":"https:\/\/buradabiliyorum.com\/en\/ftc-warns-drugmakers-against-improper-patent-filings\/","title":{"rendered":"#FTC warns drugmakers against improper patent filings"},"content":{"rendered":"<p><img decoding=\"async\" src=\"https:\/\/thehill.com\/wp-content\/uploads\/sites\/2\/2023\/03\/FTC.jpg?w=900\" \/><\/p>\n<div>\n<p>The Federal Trade Commission (FTC) is warning drug companies against improper patent filings, saying that they could potentially face legal action for doing so.<\/p>\n<p>The FTC\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.ftc.gov\/system\/files\/ftc_gov\/pdf\/p239900orangebookpolicystatement092023.pdf\">issued a statement<\/a>\u00a0Thursday saying that brand drug manufacturers could be harming competition in the generic market by improperly listing patents in the Food and Drug Administration\u2019s \u201cOrange Book\u201d \u2014 a list of certain patents on products that a brand name says would cover its product.<\/p>\n<aside class=\"ad-unit ad-unit--mr1_ab\"><\/aside>\n<p>\u201cBrand drug manufacturers are responsible for ensuring their patents are properly listed. Yet certain manufacturers have submitted patents for listing in the Orange Book that claim neither the reference listed drug nor a method of using it,\u201d the FTC wrote.<\/p>\n<p>\u201cWhen brand drug manufacturers abuse the regulatory processes set up by Congress to promote generic drug competition, the result may be to increase the cost of and reduce access to pre<a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">script<\/a>ion drugs,\u201d the commission added.<\/p>\n<p>The commission said it put out its notice to warn companies that it will be looking into whether these improper listings \u201cconstitute unfair methods of competition in violation of Section 5 of the Federal Trade Commission Act.\u201d<\/p>\n<p>The FTC said that these improper listings could \u201cdisincentivize\u201d investments in competing products and reduce patient access to more affordable drugs. It warned that it will use its \u201cfull legal authority\u201d against those who continue to improperly list patents.<\/p>\n<p>\u201cPatents improperly listed in the Orange Book can significantly undermine fair competition and harm the American public.
