{"id":595039,"date":"2023-10-20T23:27:24","date_gmt":"2023-10-20T20:27:24","guid":{"rendered":"https:\/\/en.buradabiliyorum.com\/supreme-court-will-hear-biden-social-media-case-this-term\/"},"modified":"2023-10-20T23:27:24","modified_gmt":"2023-10-20T20:27:24","slug":"supreme-court-will-hear-biden-social-media-case-this-term","status":"publish","type":"post","link":"https:\/\/buradabiliyorum.com\/en\/supreme-court-will-hear-biden-social-media-case-this-term\/","title":{"rendered":"#Supreme Court will hear Biden social media case this term"},"content":{"rendered":"<p><img decoding=\"async\" src=\"https:\/\/thehill.com\/wp-content\/uploads\/sites\/2\/2022\/08\/cellphone_cyber_tech_socialmedia_istock_0819-e1660926233328.jpeg?w=900\" \/><\/p>\n<div>\n<p>The Supreme Court said Friday it will consider a\u00a0<a href=\"https:\/\/buradabiliyorum.com\/en\/category\/social-mediaa\/\" data-internallinksmanager029f6b8e52c=\"1\" title=\"Social Media\" target=\"_blank\" rel=\"noopener\">social<\/a>\u00a0media\u00a0censorship case brought against\u00a0Biden administration officials in its next term, setting up a legal battle with resounding implications for online speech.\u00a0\u00a0<\/p>\n<p>The high court also issued a stay in an injunction ordered by the 5th U.S. Circuit Court of <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">App<\/a>eals, pausing its effect until the justices decide the case on its merits. Justices Samuel Alito, Clarence Thomas and Neil Gorsuch dissented in their decision to stay the order.<\/p>\n<aside class=\"ad-unit ad-unit--mr1_ab\"><\/aside>\n<p>\u201cAt this time in the history of our country, what the Court has done, I fear, will be seen by some as giving the Government a green light to use heavy-handed tactics to skew the presentation of views on the medium that increasingly dominates the dissemination of <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/news\/\" data-internallinksmanager029f6b8e52c=\"2\" title=\"News\" target=\"_blank\" rel=\"noopener\">news<\/a>,\u201d Alito wrote in his dissenting opinion. \u201cThat is most unfortunate.\u201d\u00a0<\/p>\n<p>The Supreme Court\u2019s decision follows an unusual <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/watch-movies-tv-seriess\/\" data-internallinksmanager029f6b8e52c=\"8\" title=\"Watch Movies &amp; TV Series\" target=\"_blank\" rel=\"noopener\">series<\/a>\u00a0of orders in the 5<sup>th<\/sup> Circuit.\u00a0<\/p>\n<p>A three-person panel in September determined that the Biden administration likely violated the First Amendment by urging social media companies to take down specific content. They ruled that federal agencies cannot \u201ccoerce\u201d social media platforms to remove posts countering the government\u2019s stance.\u00a0\u00a0<\/p>\n<p>Originally, the White House, FBI and Centers for Disease Control and Prevention were found by the panel to have crossed the line into coercion, while the National Institute of Allergy and Infectious Diseases (NIAID), Cybersecurity and Infrastructure Security Agency (CISA) and State Department did not.\u00a0\u00a0<\/p>\n<p>However, after the Justice Department requested a stay from the Supreme Court, the Republican attorneys <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/general\/\" data-internallinksmanager029f6b8e52c=\"3\" title=\"General\" target=\"_blank\" rel=\"noopener\">general<\/a> who brought the case asked the appeals court to rehear it, in hopes of broadening the its decision.\u00a0<\/p>\n<p>Without allowing time for the DOJ to reply, the appeals court granted the attorneys general\u2019s request Monday \u2014 a move that the government called \u201cunreasoned\u201d in a renewed stay request to the Supreme Court Tuesday.\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr2_ab\"><\/aside>\n<p>Then, later Tuesday, the 5<sup>th<\/sup> Circuit put its injunction on hold and withdrew its order granting a rehearing. A spokesperson for the court told The Hill the first order was based on a \u201cmisunderstanding of the court\u2019s directions\u201d and that the follow-up order \u201ccorrected that mistake.\u201d<\/p>\n<p>After rehearing the case, the appeals court determined earlier this month that CISA did overstep, barring the cybersecurity defense agency from acting to \u201ccoerce or significantly encourage\u201d tech companies to remove certain content.\u00a0<\/p>\n<p>The Republican attorney generals brought the case in a challenge to the Biden administration\u2019s efforts to curb misinformation online, which they called a \u201ccampaign of censorship\u201d by the government.<\/p>\n<aside class=\"ad-unit ad-unit--mr3_ab\"><\/aside>\n<p>A federal judge sided with them in July, blocking government officials from contacting social media companies over \u201cany manner the removal, deletion, suppression, or reduction of content containing protected free speech posted on social-media platforms.\u201d <\/p>\n<p>The 5th Circuit\u2019s decision sharply narrowed that ruling.\u00a0\n<\/p><\/div>\n<p>Copyright 2023 Nexstar Media Inc.
