Challengers argue that Trump is ineligible under the rarely used insurrection clause of the U.S. Constitution. (Nov. 2)<\/p>\n<\/div>\n<\/div>\n<p><\/media-video><\/div>\n<p>WASHINGTON \u2212 Minnesota&#8217;s highest court ruled Wednesday that former President Donald Trump should be allowed to <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>ear on the state&#8217;s presidential primary ballot next year, waving off for now an argument raised in an early test case that he had disqualified himself for a second term by attempting to overturn the 2020 election.<\/p>\n<partner-banner util-module-path=\"elements\/partner\" class=\"spacer-large\" min-height=\"600\" fluid=\"\" outstream=\"\" momentum=\"\"><\/partner-banner>\n<p>The decision is a partial victory for Trump, allowing him to stay on the ballot for the GOP primary. Minnesota may revisit the issue for the <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/general\/\" data-internallinksmanager029f6b8e52c=\"3\" title=\"General\" target=\"_blank\" rel=\"noopener\">general<\/a> election.<\/p>\n<p>The court, in a <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.mncourts.gov\/mncourtsgov\/media\/High-Profile-Cases\/A23-1354\/Order-Dismiss-Not-Stipulated,-Entire-Case.pdf\">four-page order<\/a>, said the state&#8217;s primary election was an &#8220;internal party election&#8221; and that winning that contest doesn&#8217;t necessarily place the nominee on the state&#8217;s general election ballot. There is no state law that bars a political party from nominating a candidate who may be ineligible to hold office, the court wrote.<\/p>\n<p>The court left open the possibility of revisiting the issue for the November general election.<\/p>\n<partner-inline util-module-path=\"elements\/partner\" class=\"spacer-large\" placement=\"native-article_link\" sizes=\"[[300, 250], [3, 3]]\" min-height=\"250\" fluid=\"\" outstream=\"\"><\/partner-inline>\n<p>The lawsuit, filed by a liberal group called Free Speech for People, is <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.lawfaremedia.org\/current-projects\/the-trump-trials\/section-3-litigation-tracker\">one of dozens pending across the nation<\/a> that rely on a post-Civil War-era clause of the 14th Amendment to bar anyone who &#8220;engaged in insurrection&#8221; after taking an oath to uphold the Constitution from holding higher office again.\u00a0<\/p>\n<partner-banner util-module-path=\"elements\/partner\" fluid=\"\" bottom=\"\" lazy=\"\" class=\"spacer-large\" min-height=\"390\" outstream=\"\"><\/partner-banner>\n<p>Steven Cheung, a spokesman for the Trump campaign, described the court&#8217;s order as &#8220;further validation&#8221; that the legal efforts to knock the former president off the ballot are &#8220;nothing more than strategic, un-constitutional attempts to interfere with the election by desperate Democrats who see the writing on the wall.&#8221;<\/p>\n<partner-inline util-module-path=\"elements\/partner\" placement=\"native-article_link\" sizes=\"[[300, 250], [3, 3]]\" min-height=\"250\" fluid=\"\" outstream=\"\"><\/partner-inline>\n<p>The Minnesota suit has been seen as a test case for the issue more broadly. Trump&#8217;s lawyers had argued it was never meant to apply to the office of president, which is not mentioned in the text.
