{"id":597802,"date":"2023-11-15T19:13:00","date_gmt":"2023-11-15T16:13:00","guid":{"rendered":"https:\/\/en.buradabiliyorum.com\/trump-files-motion-for-mistrial-in-ny-fraud-case\/"},"modified":"2023-11-15T19:13:00","modified_gmt":"2023-11-15T16:13:00","slug":"trump-files-motion-for-mistrial-in-ny-fraud-case","status":"publish","type":"post","link":"https:\/\/buradabiliyorum.com\/en\/trump-files-motion-for-mistrial-in-ny-fraud-case\/","title":{"rendered":"#Trump files motion for mistrial in NY fraud case"},"content":{"rendered":"<p><img decoding=\"async\" src=\"https:\/\/thehill.com\/wp-content\/uploads\/sites\/2\/2023\/11\/654978d3df0ec2.72682403.jpeg?w=900\" \/><\/p>\n<div>\n<p>Former President Trump\u2019s legal team on Wednesday requested a mistrial in his New York fraud case, claiming that the trial judge and his principal law clerk\u2019s purported bias against Trump has \u201ctainted\u201d the case.  <\/p>\n<p>\u201cThis <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>earance of bias threatens both Defendants\u2019 rights and the integrity of the<br \/>judiciary as an institution,\u201d Trump\u2019s counsel wrote in the 30-page motion. <\/p>\n<aside class=\"ad-unit ad-unit--mr1_ab\"><\/aside>\n<p>Trump\u2019s counsel pointed to posts made by Judge Arthur Engoron to a Wheatley School alumni page, which the <a rel=\"nofollow noopener\" target=\"_blank\" href=\"http:\/\/www.wheatleyalumni.org\/contact_us.htm\">judge appears to run<\/a>, referencing the case or individuals involved with it, including Trump, his son Eric Trump and Trump attorney Alina Habba.<\/p>\n<p>The motion cited New York code reading that \u201ca judge shall not make any public comment about a pending or impending proceeding in any court within the United States or its territories.\u201d<\/p>\n<p>The former president\u2019s legal team also addressed their concerns with Engoron\u2019s principal law clerk, who has become an unwitting main character in the trial. They asserted that the clerk has acted throughout the trial as a \u201cco-judge,\u201d conferring with Engoron via whispers or written notes before most orders have been issued. <\/p>\n<p>\u201cThe principal law clerk is given unprecedented and inappropriate latitude,\u201d Trump\u2019s counsel wrote.<\/p>\n<p>The filing also claimed that the clerk has made \u201cpartisan political contributions in excess of strict limits,\u201d including to groups that oppose Trump and support New York Attorney <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/general\/\" data-internallinksmanager029f6b8e52c=\"3\" title=\"General\" target=\"_blank\" rel=\"noopener\">General<\/a> Letitia James (D). <\/p>\n<p>Trump\u2019s attacks on the clerk, who frequently confers with Engoron, are what prompted a limited gag order barring him or any other parties from posting or speaking about the judge\u2019s staff. <\/p>\n<aside class=\"ad-unit ad-unit--mr2_ab\"><\/aside>\n<p>Trump\u2019s Truth <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/social-mediaa\/\" data-internallinksmanager029f6b8e52c=\"1\" title=\"Social Media\" target=\"_blank\" rel=\"noopener\">Social<\/a> account falsely derided the clerk as Senate Majority Leader\u00a0Chuck Schumer\u2019s\u00a0(D-N.Y.) \u201cgirlfriend\u201d and included personally identifying information about her. A Schumer spokesperson called the post \u201cridiculous, absurd, and false\u201d in a statement to The Hill.<\/p>\n<p>As Trump and his counsel have repeatedly towed the line regarding their comments about clerk, the judge\u2019s frustration has increased \u2014 at one point, unexpectedly calling Trump to the witness stand to explain himself. <\/p>\n<p>A spokesperson for the New York attorney general\u2019s office said in a statement that Trump is \u201conce again\u201d attempting to \u201cdismiss the truth and the facts, but the numbers and evidence don\u2019t lie.\u201d<\/p>\n<aside class=\"ad-unit ad-unit--mr3_ab\"><\/aside>\n<p>\u201cHe can keep trying to distract from his fraud, but the truth always comes out,\u201d the spokesperson said. <\/p>\n<\/div>\n<p>Copyright 2023 Nexstar Media Inc.
