{"id":598302,"date":"2023-11-20T09:33:35","date_gmt":"2023-11-20T06:33:35","guid":{"rendered":"https:\/\/en.buradabiliyorum.com\/atomic-wallet-asks-to-toss-suit-over-100m-hack-saying-it-has-no-us-ties\/"},"modified":"2023-11-20T09:33:35","modified_gmt":"2023-11-20T06:33:35","slug":"atomic-wallet-asks-to-toss-suit-over-100m-hack-saying-it-has-no-us-ties","status":"publish","type":"post","link":"https:\/\/buradabiliyorum.com\/en\/atomic-wallet-asks-to-toss-suit-over-100m-hack-saying-it-has-no-us-ties\/","title":{"rendered":"# Atomic Wallet asks to toss suit over $100M hack saying it has \u2018no US ties\u2019"},"content":{"rendered":"<p itemprop=\"description\" class=\"post__lead\" data-v-8081b7b6> The Estonia-based firm noted that only one plaintiff in the class action lawsuit is actually based in Colorado where the suit was filed. <\/p>\n<p><\/p>\n<div class=\"post-content\" data-v-8081b7b6>The company behind Atomic Wallet has asked a United States court to dismiss a class action suit seeking damages from a $100 million hack arguing the claims should\u2019ve been filed in Estonia where it&#8217;s based.<\/p>\n<p>In a Nov. 16 dismissal motion in a Colorado District Court the Estonian firm argued it has \u201cno U.S. ties\u201d and its end-user license agreement required all litigation against it be filed in its home country of Estonia.<\/p>\n<p>Atomic also argued that only one user in Colorado was allegedly affected \u2014 which wasn<\/p>\n<p>The firm also claimed the 5,500 allegedly affected Atomic users agreed to its terms of service which expressly disclaims liability for losses due to theft and limits damages to $50 per user <\/p>\n<figure><img decoding=\"async\" src=\"https:\/\/s3.cointelegraph.com\/uploads\/2023-11\/37c8edb5-0e88-44fd-a769-b0e8b636430e.png\" alt=\"\" title=\"\"><figcaption style=\"text-align: center;\"><em>Atomic\u2019s motion to dismiss the class action laid against them. Source: PACER<\/em><\/figcaption><\/figure>\n<p>Atomic said the plaintiff\u2019s negligence claims also lack legal merit because a legal duty was never created in which they were to maintain Atomic Wallet\u2019s security and to protect against hacking. <\/p>\n<p><strong><em>Related: <\/em><\/strong><strong><em>Crypto exchange Upbit targeted by hackers 159K times in H1: Report <\/em><\/strong><\/p>\n<p>&#8220;This Court has repeatedly rejected similar claims because Colorado recognizes no such duty,\u201d it wrote.<\/p>\n<p>Allegations of fraudulent misrepresentation were also struck down by the Estonian-based wallet provider.<\/p>\n<p>The plaintiffs launched the class action in August, two months after a $100 million exploit on Atomic Wallet took place with up to 5,500 users affected \u2014 with both North Korean and Ukrainian groups blamed for the attack.<\/p>\n<p><strong><em>Magazine: <\/em><\/strong><strong><em>Should crypto projects ever negotiate with hackers?
