{"id":600352,"date":"2023-12-08T06:53:14","date_gmt":"2023-12-08T03:53:14","guid":{"rendered":"https:\/\/en.buradabiliyorum.com\/texas-ag-says-abortions-still-prosecutable-despite-court-exemptions\/"},"modified":"2023-12-08T06:53:14","modified_gmt":"2023-12-08T03:53:14","slug":"texas-ag-says-abortions-still-prosecutable-despite-court-exemptions","status":"publish","type":"post","link":"https:\/\/buradabiliyorum.com\/en\/texas-ag-says-abortions-still-prosecutable-despite-court-exemptions\/","title":{"rendered":"#Texas AG says abortions still prosecutable despite court exemptions"},"content":{"rendered":"<p><img decoding=\"async\" src=\"https:\/\/thehill.com\/wp-content\/uploads\/sites\/2\/2023\/08\/647024b90b02c0.44909003.jpeg?w=900\" \/><\/p>\n<div>\n<p>Texas Attorney <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/general\/\" data-internallinksmanager029f6b8e52c=\"3\" title=\"General\" target=\"_blank\" rel=\"noopener\">General<\/a> Ken Paxton said any doctor who performs an abortion in Texas will be prosecuted, even if a woman is granted a court exception to the state\u2019s strict abortion ban.<\/p>\n<p>An Austin judge gave a woman an exception to state law on Thursday, allowing her to receive abortion care due to her fetus having a lethal medical condition.<\/p>\n<aside class=\"ad-unit ad-unit--mr1_ab\"><\/aside>\n<p>Paxton <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.texasattorneygeneral.gov\/news\/releases\/attorney-general-ken-paxton-responds-travis-county-tro\">said <\/a>Thursday that the ruling \u201cwill not insulate hospitals, doctors, or anyone else, from civil and criminal liability for violating Texas\u2019 abortion laws.\u201d<\/p>\n<p>He continued, \u201cThe TRO [temporary restraining order] will expire long before the statute of limitations for violating Texas\u2019 abortion laws expires.\u201d<\/p>\n<p>District Judge Maya Guerra Gamble\u2019s order specifically shields Kate Cox from prosecution, alongside her husband and her physician. Cox\u2019s physician argued that carrying the pregnancy to term could seriously risk her health and future fertility.<\/p>\n<p>\u201cThe idea that Ms. Cox wants desperately to be a parent and this might cause her to lose that ability is shocking, and would be a genuine miscarriage of justice,\u201d Gamble said in her ruling.<\/p>\n<p>Texas has one of the most strict abortion bans in the country, banning the procedure under most circumstances and enabling the state to prosecute people who assist women in receiving abortion care.<\/p>\n<p>There are medical exceptions to save the life of the mother, but doctors and abortion advocates argue the law is too vague on what constitutes such a risk, so physicians won\u2019t risk providing abortions for fear of potential criminal charges or lawsuits.<\/p>\n<aside class=\"ad-unit ad-unit--mr2_ab\"><\/aside>\n<p>Paxton\u2019s office also sent a letter to the three hospitals that Cox\u2019s doctor has admitting privileges in and threatened that any medical staff that assists in an abortion procedure and the hospitals themselves would also face consequences if the procedure went forward.<\/p>\n<p>\u201cYour hospital may be liable for negligently credentialing the physician and failing to exercise <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>ropriate professional judgment, among other potential regulatory and civil violations, if you permit Dr. Karsan to perform an unlawful abortion,\u201d Paxton wrote.<\/p>\n<p>Former Rep.
