{"id":600617,"date":"2023-12-10T14:00:00","date_gmt":"2023-12-10T11:00:00","guid":{"rendered":"https:\/\/en.buradabiliyorum.com\/trump-to-retake-stand-in-new-york-fraud-trial\/"},"modified":"2023-12-10T14:00:00","modified_gmt":"2023-12-10T11:00:00","slug":"trump-to-retake-stand-in-new-york-fraud-trial","status":"publish","type":"post","link":"https:\/\/buradabiliyorum.com\/en\/trump-to-retake-stand-in-new-york-fraud-trial\/","title":{"rendered":"#Trump to retake stand in New York fraud trial"},"content":{"rendered":"<p><img decoding=\"async\" src=\"https:\/\/thehill.com\/wp-content\/uploads\/sites\/2\/2023\/12\/trumpdonald_120723_ap_ny1.jpg?w=900\" \/><\/p>\n<div>\n<p>Donald Trump will give the final word in his defense against claims his business engaged in a decade of fraud as the New York trial threatening his business empire nears its end.\u00a0<\/p>\n<p>The former president is expected to take the witness stand for a third time Monday, this time under questioning from his own legal team.\u00a0\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr1_ab\"><\/aside>\n<p>In testimony last month during the state\u2019s case, Trump defended his business practices by downplaying key financial documents and declaring the trial corrupt. His fiery testimony often grew political, more akin to a stump speech than a direct examination as he railed against the judge and New York attorney <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/general\/\" data-internallinksmanager029f6b8e52c=\"3\" title=\"General\" target=\"_blank\" rel=\"noopener\">general<\/a> whom he decried as \u201cfrauds\u201d and \u201cpolitical hacks.\u201d\u00a0<\/p>\n<p>\u201cIt\u2019s a disgrace that a case like this is going on; all you have to do is read the legal scholars \u2014 the papers \u2014 and you\u2019ll know,\u201d Trump testified in November, raising his voice. \u201cThis is a political witch hunt.\u201d\u00a0<\/p>\n<p>But with Trump\u2019s counsel steering the questioning this time, the former president will have significantly more latitude to set the narrative and espouse his side of the story.\u00a0<\/p>\n<p>Throughout the defense case, which began in mid-November, several witnesses reprised previous testimony while offering up their own spin.\u00a0<\/p>\n<p>The first time Donald Trump Jr. testified in the New York attorney general\u2019s case, he distanced himself from documents at the heart of the case \u2013 his father\u2019s statements of financial condition, which detail the value of the Trump Organization\u2019s various assets and were sent to banks and insurers to secure loans and deals. New York Attorney General Letitia James\u2019s (D) lawsuit claims the Trump Organization falsely adjusted the value of its assets to receive tax and insurance benefits.\u00a0<\/p>\n<p>A defendant in the case, Donald Trump Jr. said he did sign off on Trump\u2019s financial statements while his father was president. However, he said he counted on the work of accountants and executives like then-Chief Financial Officer Allen Weisselberg to be correct.\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr2_ab\"><\/aside>\n<p>\u201cAs a trustee, I have an obligation to listen [to] those who are expert \u2014 who have an expertise of these things,\u201d Donald Trump Jr. testified.\u00a0<\/p>\n<p>But when he testified again in the defense case, the key financial statements were hardly the focus of his testimony. Instead, Donald Trump Jr. walked Judge Arthur Engoron through a glossy slideshow titled \u201cThe Trump Story\u201d \u2014 a flashy narration of the Trump Organization\u2019s origin story, complete with sleek photographs of the company\u2019s luxury golf courses and hotels. Notably glossed over were the valuations of those properties.\u00a0<\/p>\n<p>Jeff McConney, the Trump Organization\u2019s ex-corporate controller and another defendant in the case, had similarly variant testimonies when called as a state versus defense witness.\u00a0\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr3_ab\"><\/aside>\n<p>McConney\u2019s testimony was used as a vehicle for state lawyers to show evidence that Trump\u2019s statements of financial condition were integral to some loan deals. He also said he believed Trump reviewed those documents before they were finalized, linking Trump to the skewed documents.\u00a0\u00a0<\/p>\n<p>But McConney\u2019s testimony for the defense focused far less on logistics. Nearly in tears, he testified to the exhaustion caused by the Trump Organization\u2019s barrage of legal issues, which ultimately led the 36-year veteran of the company to retire in February.\u00a0<\/p>\n<p>\u201cI\u2019m very proud of the work that I did,\u201d McConney said before detailing all the investigations and legal proceedings he\u2019s been pulled into.\u00a0\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr4_ab\"><\/aside>\n<p>\u201cI just wanted to relax and stop being accused of misrepresenting assets for the company that I loved working for,\u201d he said.\u00a0<\/p>\n<p>When Trump retakes the stand, arguments he attempted to make while testifying for the state could be bolstered and reframed after other defense witness testimony backed him up.\u00a0<\/p>\n<p>Several Deutsche Bank executives, for example, affirmed defense arguments including that the bank wanted to work with the Trump Organization, did its own due diligence and found no fraud. Trump made those points in his own testimony.\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr5_ab\"><\/aside>\n<p>\u201cBanks check the work,\u201d Trump testified, arguing that his statements of financial condition weren\u2019t just taken at face value by the bankers with which Trump Organization executives worked.\u00a0\u00a0<\/p>\n<p>Deutsche Bank Managing Director David Williams\u2019s testified last month for the defense that bankers viewed their clients\u2019 statements of financial condition as \u201csubjective or subject to estimates\u201d \u2014 and, that the bank took its own look at reports of net worth.\u00a0<\/p>\n<p>\u201cI think we expect clients\u2019 provided information to be accurate,\u201d Williams said. \u201cAt the same time, it\u2019s not an industry standard that these statements be audited.\u201d\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr6_ab\"><\/aside>\n<p>\u201cThey\u2019re largely reliant on the use of estimates,\u201d he added, so bankers routinely \u201cmake some adjustments.\u201d\u00a0<\/p>\n<p>It\u2019s all-but inevitable that Trump\u2019s inflammatory political rhetoric will surface again, as well.\u00a0<\/p>\n<p>In the month since he testified, Trump and his counsel have been locked in a battle with the trial judge, whom they claim has been biased against them from the start. The dispute began after Engoron imposed a gag order on Trump and his lawyers barring them from publicly discussing the judge\u2019s staff.\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr7_ab\"><\/aside>\n<p>The order doesn\u2019t prevent Trump\u2019s team from criticizing the judge himself or James, the state\u2019s top prosecutor. Nonetheless, that contention has placed Engoron directly in Trump\u2019s line of fire on <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/social-mediaa\/\" data-internallinksmanager029f6b8e52c=\"1\" title=\"Social Media\" target=\"_blank\" rel=\"noopener\">social media<\/a> and in person. During his testimony last month, Trump lambasted the judge as \u201cTrump hating\u201d and questioned his impartiality.\u00a0<\/p>\n<p>The former president\u2019s legal team attempted to delay his testimony until after their <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>eal of the gag order plays out, but the judge forcefully denied that effort.\u00a0<\/p>\n<p>\u201cHe is not capable of fully testifying because he is subject to the gag order,\u201d Trump attorney Chris Kise argued,<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/abcnews.go.com\/US\/live-updates\/trump-fraud-trial\/potential-for-violence-justifies-gag-order-judges-lawyer-argues-105436889?id=103642561\"> according to ABC News<\/a>.\u00a0<\/p>\n<p>\u201cAbsolutely not. No way. No how. It\u2019s a nonstarter,\u201d Engoron said.\u00a0<\/p>\n<p>Trump\u2019s third round of testimony \u2013 following a judge-ordered stint on the witness stand over a violation of the gag order and his examination by the state \u2013 could also give insight into how he\u2019ll behave as his criminal trials get underway in the new year.\u00a0<\/p>\n<p>The former president faces a combined 91 charges across four criminal cases, the first of which is expected to head to trial in Washington on March 4.\u00a0\u00a0<\/p>\n<p><em>The Associated Press contributed.<\/em><\/p>\n<\/div>\n<p>Copyright 2023 Nexstar Media Inc.
