The act came <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.dailywire.com\/news\/desantis-vows-to-repeal-trumps-first-step-act-hits-trump-for-not-having-control-of-his-own-agencies\">under<\/a> fire at the outset of the primary season from other Republican candidates seeking to challenge Trump and define themselves as \u201ctough on crime.\u201d If they hope to topple the MAGA behemoth, however, they\u2019ll need to think twice about ditching his criminal justice reforms, and think critically about addressing crime.\u00a0<\/p>\n<p>The First Step Act created federal in-prison recidivism reduction programming, made modest sentencing reforms, and increased oversight and operations for successful reentry into society after incarceration \u2014 all reforms still needed in many states around the country. As primary voting gets underway next year, the remaining candidates should learn from the successes of the First Step Act in standing behind this truth: With adequate guardrails for public safety and well-designed incentives for better behavior, criminal justice reforms improve outcomes for all. \u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr1_ab\"><\/aside>\n<p>To have any success against Trump, who just this week put out his campaign\u2019s \u201c<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/cdn.donaldjtrump.com\/public-files\/press_assets\/president-trump-platinum-plan-final-version.pdf\">Platinum Plan<\/a>\u201d including a commitment to a \u201cSecond Step Act,\u201d other candidates must embrace what he did well and commit to further reforms.\u00a0\u00a0<\/p>\n<p>The Federal Bureau of Investigation has <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.fbi.gov\/news\/press-releases\/fbi-releases-2022-crime-in-the-nation-statistics\">released<\/a> new crime numbers and a new poll indicating that Americans are <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/news.gallup.com\/poll\/544439\/americans-critical-criminal-justice-system.aspx\">more critical<\/a> of our country\u2019s criminal justice system than in recent years. Especially when public feelings of day-to-day safety are on the decline in cities such as <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/chicago.suntimes.com\/2023\/2\/13\/23594709\/sun-times-poll-public-safety-crime-chicago-letters\">Chicago<\/a> and <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.sfchronicle.com\/sf\/article\/survey-crime-san-francisco-17894081.php\">San Francisco<\/a>, the successful candidate will need to stake out a viable policy platform to address the concerns of millions of Americans.\u00a0\u00a0<\/p>\n<p>Ron DeSantis\u2019s out-of-the-gate rejections of the First Step Act\u00a0provided a perfect case of how not to proceed, proposing a repeal of the ground-breaking reform <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.congress.gov\/bill\/115th-congress\/senate-bill\/756\">law<\/a> and <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.dailywire.com\/news\/desantis-vows-to-repeal-trumps-first-step-act-hits-trump-for-not-having-control-of-his-own-agencies\">calling<\/a> it a \u201cjailbreak bill.\u201d The presidential hopeful accused the act of \u201callow[ing] dangerous people out of prison,\u201d despite having actually <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/clerk.house.gov\/Votes\/2018215\">voted for<\/a> this legislation in Congress and having <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/floridapolitics.com\/archives\/300081-desantis-signs-criminal-justice-package\/\">signed into law<\/a> as governor a bill <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/communitylawfirm.com\/floridas-first-step-act\">dubbed<\/a> the \u201cFlorida First Step Act,\u201d which in many ways <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.flsenate.gov\/Session\/Bill\/2019\/7125?pref=full\">mirrored<\/a> the federal legislation enacted nearly half a decade ago.\u00a0\u00a0<\/p>\n<p>Such hypocritical claims are nothing more than partisan political fodder. It is this type of knee-jerk argument that candidates need to avoid if they want to be successful.\u00a0\u00a0<\/p>\n<p>DeSantis\u2019s <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>arently newfound position on reform was a deliberate play into the <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.pewresearch.org\/short-reads\/2022\/10\/31\/violent-crime-is-a-key-midterm-voting-issue-but-what-does-the-data-say\/\">rise-in-violent-crime narrative<\/a> we saw in the 2022 election season, as well as a way for DeSantis to <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/reason.com\/2023\/03\/30\/ron-desantis-reportedly-plans-to-portray-trump-as-soft-on-crime\/\">differentiate himself<\/a> from former President Trump. These angles are likely to <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.post-gazette.com\/opinion\/Op-Ed\/2022\/11\/18\/tough-on-crime-midterms-2022-oz-mejia\/stories\/202211180034\">lose<\/a> in 2024. The public <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.forbes.com\/sites\/carlieporterfield\/2020\/06\/23\/a-whopping-95-of-americans-polled-support-criminal-justice-reform\/\">by and large<\/a> <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/news.gallup.com\/poll\/324164\/fewer-americans-call-tougher-criminal-justice-system.aspx\">understands<\/a> that reducing recidivism and fixing the broken parts of a system that often misuses resources is key to enhancing public safety and addressing the very rise in violent crime on which reflexive arguments against reform depend.\u00a0<\/p>\n<p>The numbers bear this out: Recidivism rates for those released under the First Step Act <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.ojp.gov\/first-step-act-annual-report-april-2022\">are nearly threefold lower<\/a> than the Bureau of Prisons\u2019s self-claimed <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.bop.gov\/about\/agency\">average<\/a>, and research conducted since the implementation of the First Step Act in 2019 indicates that similar public safety reforms \u2014 such as pretrial reforms and alternatives to arrest \u2014 have <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.rstreet.org\/commentary\/criminal-justice-reform-efforts-and-rise-in-crime-conclusion\/\">no correlation<\/a> to the rise in violent crime seen over the course of the pandemic.\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr2_ab\"><\/aside>\n<p>For candidates Chris Christie and Nikki Haley, this point rings true as well, and their own tenures back it up \u2014 a promising sign for how they would approach crime given a larger executive position. Both of their home states of New Jersey and South Carolina, respectively, have been held up as models of reforms that address public concerns about safety, while simultaneously improving other outcomes of the justice system; these include reducing cyclical incarceration, economic disparities and barriers that exist for those with criminal records.\u00a0\u00a0<\/p>\n<p>New Jersey\u2019s careful reform of cash bail and pretrial detention under Gov. Christie\u2019s leadership \u2014 which he has rightly <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.njspotlightnews.org\/video\/christie-defends-bail-reform-says-new-jersey-did-it-the-right-way\/\">defended<\/a> in recent months \u2014 has been lauded as the <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/news.bloomberglaw.com\/litigation\/michigan-cues-up-bail-overhaul-as-other-states-eye-illinois-ban\">gold standard<\/a> of bail reform in our country, accomplishing an effective elimination of cash bail while improving public safety. This resounding success, now a decade in the books, is a slam-dunk counter to the pervasive current narrative that the result of limiting cash bail is inevitably an increase in crime. Christie has also spoken up <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.nbcnews.com\/news\/world\/chris-christie-war-drugs-failure-flna872472\">many<\/a> <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.vox.com\/policy-and-politics\/2015\/11\/2\/9659798\/chris-christie-war-on-drugs\">times<\/a> <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.turnbridge.com\/news-events\/latest-articles\/chris-christie-view-on-addiction\/\">over<\/a> the <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.marijuanamoment.net\/chris-christie-vows-to-end-the-drug-war-if-elected-president-but-only-partially\/\">years<\/a> on the need to end the war on drugs and seek alternatives to the criminal justice system to address substance use and behavioral and mental health.\u00a0\u00a0<\/p>\n<p>South Carolina, by a similar token, dramatically improved its criminal justice system during Haley\u2019s tenure as governor, and the state was <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/bit.ly\/3GBlLAO\">heralded<\/a> as an example of the conservative and compassionate way to approach crime initially modeled by the First Step Act itself. Changes implemented from 2010 onward resulted in a prison population reduction of about 15 percent <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.nytimes.com\/interactive\/2023\/10\/17\/us\/politics\/republican-candidates-2024-crime.html\">while<\/a> Haley was governor. The successes of these reforms were also seen in the state\u2019s comparatively low recidivism and violent crime <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/tigerprints.clemson.edu\/all_theses\/3828\/#:~:text=SB%201154%20adopted%20a%20series,and%20credit%20programs%20for%20early\">rates<\/a>.\u00a0\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr3_ab\"><\/aside>\n<p>Vivek Ramaswamy\u2019s notably more populist style of rhetoric make his intentions on crime tough to read when it comes to particular policies, but his apparent <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/ny1.com\/nyc\/all-boroughs\/politics\/2023\/08\/12\/how-vivek-ramaswamy-is-pushing---delicately---to-win-over-trump-supporters\">efforts<\/a> to be a similar figure to Trump this election give hope that he may ultimately come down in favor of reforms that Trump himself supported \u2014 at least on the campaign trail. After all, there is little tougher on crime than preventing crime from happening in the first place, and that is what reform is all about.\u00a0<\/p>\n<p>At the end of the year as candidates gear up for primary voting, they must remember the <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.ojp.gov\/first-step-act-annual-report-april-2023\">successes<\/a> of the First Step Act in its first five years. Reforms in its style just win \u2014 both politically and for public safety.
