Rather than focusing on healing physically and\u00a0emotionally, she was arrested and charged with a felony,\u201d her attorney, Traci Timko, told CNN in an email.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clqbb64we0001356hktbl1kjw@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      \u201cMs. Watts\u2019 case is pending before the Trumbull County Grand Jury. I have advised\u00a0her not to speak publicly until the criminal matter has resolved.\u201d\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clqc60m15000s356h6a2ussg7@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Though a coroner\u2019s office report said the fetus was not viable and had died in the womb, Watts\u2019 case highlights the extent to which prosecutors can charge a woman whose pregnancy has ended \u2013 whether by abortion or miscarriage.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clqc6cswa0003356h9qywkz81@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      After last year\u2019s Supreme Court decision overturning Roe v. Wade and the federal right to an abortion, a host of state trigger laws went into effect across the country that placed new restrictions or bans on abortion.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clqc6cswa0004356hooh5as6v@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      In turn, some women carrying fetuses with fatal abnormalities have been barred from having an abortion in their home states. Other women with potentially life-threatening pregnancies have also been unable to get an abortion, as medical exemption clauses can be vague and medical providers fear severe legal consequences.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clqc6dlzg0006356ha5zcv91q@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      When asked whether the charge against Watts may have been influenced by the repeal of Roe v. Wade, her attorney said ignorance is the main factor.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clqc6irx50008356hqwxgxj8z@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      \u201cI believe that this charge stems from the lack of knowledge and\/or insight that men have\u00a0regarding the realities of miscarriage and women\u2019s health in <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/general\/\" data-internallinksmanager029f6b8e52c=\"3\" title=\"General\" target=\"_blank\" rel=\"noopener\">general<\/a>,\u201d Timko told CNN.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clqc6uuie0004356h33jbqa0s@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      \u201cI don\u2019t believe the fetal personhood issue was something\u00a0they considered or found relevant.\u00a0I believe this case demonstrates the need for education and showcases the sweep that the fetal personhood debate has even outside the context of abortion.\u201d\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clqchde4l00053b6h0zyk5g3r@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      A prosecutor said Watts\u2019 actions after passing the fetus are at the center of the case.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clqchdwrq00073b6hztt368sk@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      \u201cThe issue isn\u2019t how the child died, when the child died. It\u2019s the fact that the baby was put into a toilet, large enough to clog up the toilet, left in that toilet, and she went on her day,\u201d prosecutor Lewis Guarnieri said at preliminary hearing last month, according to footage from\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.wkbn.com\/news\/local-news\/warren-news\/trumbull-county-grand-jury-to-hear-abuse-of-corpse-case\/\">WKBN<\/a>.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clqciuz3l000r356hqb2jxbft@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Trumbull County Prosecutor\u2019s Office spokesperson Guy M. Vogrin declined to comment on the case, telling CNN all cases at the grand jury level are secret proceedings under Ohio law. CNN has also reached out to the Warren Police Department for comment.\n  <\/p>\n<h2 class=\"subheader\" data-editable=\"text\" data-uri=\"cms.cnn.com\/_components\/subheader\/instances\/clqcgh5yr0003356hhor2nc88@published\" data-component-name=\"subheader\" id=\"days-of-bleeding-and-a-critical-timeline\" data-article-gutter=\"true\"><span class=\"ez-toc-section\" id=\"Days_of_bleeding_and_a_critical_timeline\"><\/span>\n    Days of bleeding and a critical timeline<\/p>\n<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clqcgh5yr0004356hqigiqy7h@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Watts went to a hospital three times in four days due to vaginal bleeding, a report from the Trumbull County Coroner\u2019s Office says.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clqcgh5yr0005356hkw9cxsyr@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      When she was first admitted to the Labor and Delivery Department at St. Joseph\u2019s Hospital on September 19, \u201cShe was diagnosed with premature rupture of membranes and severe oligohydramnios,\u201d the report states. In other words, her water had broken prematurely, and she had exceptionally low \u2013 if any \u2013 amniotic fluid.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clqcgh5yr0006356h3wjtwkr1@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      \u201cAlthough a fetal heartbeat was found, it was recommended by medical staff that an induction occur of the nonviable fetus,\u201d the coroner\u2019s office report states.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clqcgh5yr0007356hmd8j022n@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      At the time, Watts\u2019 pregnancy \u201cwas 21 weeks, 5 days gestation,\u201d the report says. In Ohio, abortions are legal until fetal viability \u2013 which is generally considered to be around 22 to 24 weeks of pregnancy. After\u00a0viability, the state can legally restrict abortion access unless the patient\u2019s life or health are at risk.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clqcgh5yr0008356hj3cgnngj@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      However, \u201cBrittany Watts signed herself out of the hospital against medical advice on 9\/19\/2013,\u201d the coroner\u2019s office report states. CNN has asked her attorney about why Watts may have left the hospital without having the nonviable fetus induced, as recommended by the medical staff.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clqcgh5yr000a356hzce947x0@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      The next day, September 20, Watts returned \u201cfor the same issue and left against medical advice again,\u201d the coroner\u2019s office report states.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clqcgj2o0000k356h6oo3b2yz@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Watts returned on September 20 expecting to be induced to deliver her preterm pregnancy, according to <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.washingtonpost.com\/nation\/2023\/12\/15\/ohio-woman-miscarriage-abuse-of-corpse-grand-jury\/\">The Washington Post<\/a>. But for hours doctors and officials mulled the ethics of inducing labor for a woman who had been diagnosed with preterm premature rupture of membranes (PPROM), had no detectable amniotic fluid, was bleeding vaginally and had advanced cervical dilation, the Post reported. Watts eventually left.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clqcgh5yr000b356h9mnygaoo@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Then on September 22, Watts returned to the hospital \u201cfor vaginal bleeding with retained placenta after a home delivery,\u201d the coroner\u2019s office report states. \u201cAccording to medical records, Brittany Watts stated that at approximately 5:58am \u2026 she delivered the fetus into the toilet of her residence.\u201d\n  <\/p>\n<h2 class=\"subheader\" data-editable=\"text\" data-uri=\"cms.cnn.com\/_components\/subheader\/instances\/clqchb3nv00033b6h9fv4i2xg@published\" data-component-name=\"subheader\" id=\"police-and-coroners-staff-respond-to-home\" data-article-gutter=\"true\"><span class=\"ez-toc-section\" id=\"Police_and_coroners_staff_respond_to_home\"><\/span>\n    Police and coroner\u2019s staff respond to home<br \/>\n<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clqcnhplh000k356hl26nh62x@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      The hospital staff notified the Warren Police Department, which responded to Watts\u2019 home, the coroner\u2019s office report says.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clqcsm4800002356h49d5krsm@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      CNN reached out to the hospital for comment about why staff notified police. Maureen Richmond, vice president of integrated communications at Mercy Health \u2013 a Catholic health care system that includes St. Joseph Warren Hospital \u2013 sent the following statement to CNN:\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clqcspucl0004356habu4zw0r@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      \u201cThe safety and security of every patient who comes to us for care is our highest priority. Out of respect for patient privacy, we will not discuss individual specifics of care.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clqcn0ldk0004356hmxvnxvuv@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      According to the coroner\u2019s office report, \u201cBrittany stated to police that she had taken the fetus out of the toilet and placed in it a black bucket. She then told police that she put the remains near the garage in the back yard.\u201d\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clqcgh5yr000d356h3zuukojk@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      An investigator from the coroner\u2019s office also responded to the scene. \u201cNear the side of the garage, next to a large trash can, there was a pile of tissue, blood and what appeared to be paper towels in the weeds,\u201d the coroner\u2019s office investigator, Alaina Jamison, wrote in the report.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clqcgh5yr000e356hu21rhnkx@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      When Warren police detectives were called out to investigate the scene, they discovered \u201cthe downstairs toilet was filled with blood,\u201d the coroner\u2019s office report says. \u201cLooking into the toilet, it was filled to the brim with water, blood, blood clots and tissue.\u201d\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clqcgh5yr000f356hbav6us5x@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      The coroner\u2019s investigator checked inside the toilet bowl and \u201cfelt what appeared to be a small foot with toes,\u201d the investigator\u2019s report says. The toilet was later broken apart by Warren police detectives, \u201cand the fetus was retrieved,\u201d the report states.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clqcgh5yr000g356hdfvu75zo@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      An autopsy revealed the fetus\u2019 cause of death was intrauterine fetal demise \u2013 meaning the fetus died inside the womb \u2013 due to severely low amniotic fluid from the premature rupture of membranes.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clqcm4zh3000y356hf3r9fwv7@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Miscarriage is most common early in the first trimester, often before a woman knows she\u2019s pregnant. It\u2019s less common to naturally lose a fetus more than halfway through gestation \u2013 often known as stillbirth. About 21,000 stillbirths happen each year in the US \u2013 about 1 in 175 pregnancies, according to the US Centers for Disease Control and Prevention.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clqc5ojm80006356hfjk88dsf@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Ohio law<strong> <\/strong>defines abuse of a corpse in somewhat subjective terms.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clqc5ojm80007356h08tqsodz@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      \u201cNo person, except as authorized by law, shall treat a human corpse in a way that the person knows <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/codes.ohio.gov\/ohio-revised-code\/section-2927.01\">would outrage reasonable family sensibilities<\/a>,\u201d the law states. This kind of \u201cabuse of a corpse\u201d would be a second-degree misdemeanor.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clqc5ojm80008356hevkjhoj1@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      In addition, \u201cNo person, except as authorized by law, shall treat a human corpse in a way that would <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/codes.ohio.gov\/ohio-revised-code\/section-2927.01\">outrage reasonable community sensibilities<\/a>,\u201d the law says.
