Chamberlain and Carmenate allege that the popular Bronx MC \u2014 along with her frequent producer RIOTUSA \u2014 copied their song \u201c<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.youtube.com\/watch?v=gluHUnUJrYY\">In That Mood<\/a>\u201d to create \u201cIn Ha Mood,\u201d the third and final pre-release single from her January 2023 debut EP, <i>Like..??<\/i>. Along with Ice Spice and RIOTUSA, the lawsuit names Capitol Records, 10K Projects, and their parent company, Universal Music Group, as defendants.<\/p>\n<div class=\"\" style=\"padding-bottom: 20px; margin-top: 20px; text-align: left;\">\n<\/div>\n<p>            \u201cThe similarities between \u2018In Ha Mood\u2019 and the Work [&#8216;In That Mood&#8217;] \u2014 including the key phrase used in the chorus and repeated in a substantially similar manner numerous times throughout both songs \u2014 are such that it is simply not reasonable to believe that \u2018In Ha Mood\u2019 could have been created without having heard the Work first,\u201d Chamberlain and Carmenae\u2019s attorney Chester Chester R. Ostrowski writes in an initial complaint, filed on Wednesday in New York federal court.<\/p>\n<p>            Chamberlain and Carmenate first teased \u201cIn That Mood\u201d on Instagram in August 2021, according to the complaint\u2019s timeline. The track then briefly appeared on streaming services early the following year (\u201cin connection with licensing for an advertising campaign that never ran\u201d) before being released on D.Chamberz\u2019s summer 2022 album <i>Boom Bap 2 Drill Rap<\/i>. More importantly, Ostrowski argues, Chamberlain performed the song \u201cno less than 36 times\u201d and has reason to believe that Ice Spice, RIOTUSA, \u201cand\/or members of their creative teams were present\u201d during at least one of those performances prior to the inception of \u201cIn Ha Mood.\u201d <\/p>\n<div class=\"\" style=\"padding-bottom: 20px; margin-top: 20px; text-align: left;\">\n<\/div>\n<p>            The plaintiffs also point to an Instagram video RIOTUSA posted on November 15, 2021 of Ice Spice\u2019s \u201c<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.youtube.com\/watch?v=U77JyALAfk0\">No Clarity<\/a>\u201d playing on Hot 97.
