Touting his recent wins in Iowa and New Hampshire, the former president\u2019s team warned the justices that disqualifying Trump would \u201cunleash chaos and bedlam.\u201d\u00a0<\/p>\n<p>\u201cIn our system of \u2018government of the people, by the people, [and] for the people,\u2019 the American people\u2014 not courts or election officials \u2014 should choose the next President of the United States,\u201d Trump\u2019s lawyers wrote in their final pitch before Thursday\u2019s arguments.\u00a0<\/p>\n<p>Here\u2019s what Trump\u2019s lawyers are expected to argue before the Supreme Court.<\/p>\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Trump_didnt_engage_in_insurrection\"><\/span><strong>Trump didn\u2019t engage in insurrection<\/strong>\u00a0<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>To disqualify Trump, the Colorado Supreme Court found Trump \u201cengaged in insurrection.\u201d\u00a0<\/p>\n<p>Trump\u2019s lawyers, however, argue that Jan. 6 wasn\u2019t an insurrection as defined in the clause, which was originally ratified after the Civil War and intended to prevent former Confederates from returning to federal office.\u00a0<\/p>\n<p>Even if it was, Trump\u2019s team contends the Colorado voters who sued still can\u2019t connect the Capitol attack to their client<\/p>\n<aside class=\"ad-unit ad-unit--mr2_ab\"><\/aside>\n<p>With the Jan. 6 riot now front-and-center for the Supreme Court, legal observers are closely watching how much the justices delve into the politically contentious issue during Thursday\u2019s arguments.\u00a0\u00a0<\/p>\n<p>Alex Reinert, a Benjamin N. Cardozo School of Law professor, noted there also is the question of whether the Supreme Court will give deference to the lower court\u2019s factual findings on Trump\u2019s conduct.\u00a0<\/p>\n<p>\u201cThere\u2019s no question that there was enough evidence for the trial court to find that he engaged in insurrection. I don\u2019t know that the court is going to do that,\u201d said Reinert, who clerked for Justice Stephen Breyer the term the court decided Bush v. Gore.\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr3_ab\"><\/aside>\n<p>\u201cAnd I think the court has to answer the question for itself, which, frankly, is a little bit fraught for it to do.\u201d<\/p>\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Presidents_are_not_a_federal_%E2%80%98officer\"><\/span><strong>Presidents are not a federal \u2018officer\u2019<\/strong>\u00a0\u00a0<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Many legal observers believe the Supreme Court won\u2019t reach that contentious insurrection issue at all. Instead, the court could keep Trump\u2019s name on the ballot by reversing the lower ruling on any one of several other issues.\u00a0\u00a0<\/p>\n<p>Among those include Trump\u2019s contention that the 14<sup>th<\/sup> Amendment\u2019s insurrection ban doesn\u2019t apply to the presidency.\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr4_ab\"><\/aside>\n<p>The argument is two-fold: Trump first argues he did not previously hold a covered position, as the ban only reaches people who engaged in insurrection after serving as \u201can officer of the United States.\u201d\u00a0<\/p>\n<p>Second, Trump notes that the Amendment only prevents those covered individuals from holding \u201cany office\u2026under the United States,\u201d asserting that category similarly doesn\u2019t include the presidency.\u00a0<\/p>\n<p>\u201cTrump\u2019s briefing so far has really leaned into the argument that the presidency is not an office of the United States, which means that presidency is not covered by Section 3, and therefore, this whole case should disappear,\u201d said Derek Muller, a law professor at Notre Dame who filed a brief in the matter.<\/p>\n<aside class=\"ad-unit ad-unit--mr5_ab\"><\/aside>\n<p>Backed by some conservative legal scholars, the argument leans on how the Constitution uses the term \u201cofficer\u201d in other sections.\u00a0<\/p>\n<p>\u201cThey don\u2019t use the phrase officer the United States to include the president anywhere else in the Constitution,\u201d noted John Yoo, a law professor at the University of California, Berkeley who filed a friend-of-the-court brief backing Trump.\u00a0<\/p>\n<p>A former clerk to Justice Clarence Thomas, Yoo and other proponents also note how the 14<sup>th<\/sup> Amendment\u2019s drafters spelled out other positions the insurrection ban applies to, but they did not explicitly list the presidency.\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr6_ab\"><\/aside>\n<p>\u201c<a href=\"https:\/\/buradabiliyorum.com\/en\/category\/general\/\" data-internallinksmanager029f6b8e52c=\"3\" title=\"General\" target=\"_blank\" rel=\"noopener\">General<\/a>ly, in law, where the writers say, we want to include A, B, C, and E, you don\u2019t naturally say, \u2018oh, you should have included D and we\u2019re just going to include it for you.\u2019 That\u2019s kind of the approach people who think the presidency should be included are using,\u201d said Yoo.\u00a0<\/p>\n<p>On the other hand, the challengers\u2019 attorneys argued \u201cIt would defy common sense to hold that Section 3 disqualifies every oath-breaking insurrectionist officer (down to postmaster or county sheriff) except the most powerful one\u2014a former Commander-in-Chief.\u201d\u00a0<\/p>\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Section_3_of_the_14th_Amendment_is_not_self-executing\"><\/span><strong>Section 3 of the 14<sup>th<\/sup> Amendment is not self-executing<\/strong>\u00a0<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Trump next contends that the insurrection ban cannot be enforced without legislation from Congress.\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr7_ab\"><\/aside>\n<p>He largely relies on Griffin\u2019s Case, a decision authored by then-Chief Justice Salmon Chase as he presided over a lower court in 1869, one year after the 14th Amendment was ratified. Chase opted against disqualifying a judge even though they were an ex-Confederate, ruling that \u201clegislation by Congress was necessary\u201d to enforce the insurrection ban.\u00a0<\/p>\n<p>All sides agree it is not binding precedent, and critics have suggested Chase\u2019s decision was impacted by his political ambitions to be president and should be discredited.\u00a0\u00a0<\/p>\n<p>Trump and his backers have extensively cited the case, suggesting it as a persuasive authority the justices should look to in their deliberations.\u00a0<\/p>\n<p>\u201cHere\u2019s what someone who was a key member of the time \u2014 he was Chief Justice of the United States, and before that, he was a member of Lincoln\u2019s cabinet and one of the great abolitionist lawyers; in a way he was more famous than Lincoln \u2014 and this is what he thought,\u201d said Yoo, whose brief cites the case a handful of times.\u00a0<\/p>\n<p>While Trump argues the plaintiffs should defer to Congress, detractors note that nothing suggests Congress believed federal legislation was the only way to enforce the rule \u2013 that states can\u2019t also enforce their own laws or regulations.\u00a0<\/p>\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Section_3_prevents_holding_office_not_running_for_it\"><\/span><strong>Section 3 prevents holding office, not running for it<\/strong>\u00a0<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Trump also argues he must remain on the ballot because the ban only prevents individuals from \u201cholding\u201d office, not seeking it.\u00a0<\/p>\n<p>\u201cSection 3 is a prohibition only on holding office, and Congress can waive this prohibition between now and the end of the next presidential term,\u201d Trump\u2019s attorneys wrote.\u00a0<\/p>\n<p>But that argument only kicks things down the road, Muller said.\u00a0\u00a0<\/p>\n<p>\u201cIf he\u2019s elected, if he wins the majority vote, does this put pressure on Congress to refuse to count votes cast for him? Does this put pressure on the legal system to challenge his eligibility after he\u2019s taken office?\u201d Muller said. \u201cWho knows what could come from that.\u201d\u00a0<\/p>\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Colorado_Supreme_Court_violated_state_law\"><\/span><strong>Colorado Supreme Court violated state law<\/strong>\u00a0<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Trump\u2019s final argument purports he cannot be removed from the ballot because the Colorado courts that deemed him ineligible incorrectly interpreted state law.\u00a0\u00a0<\/p>\n<p>\u201cIf the courts interpret a state law so badly it mangles the intent of the legislature, then, in effect, it\u2019s\u2026arrogated power unto itself in such a way that it has really usurped the legislature of its constitutional function,\u201d Muller said.\u00a0<\/p>\n<p>Trump\u2019s counsel argued that Colorado\u2019s judiciary can only intervene in ballot disputes when an individual \u201ccharged with a duty\u201d under the Colorado Election Code \u2013 like Colorado Secretary of State Jena Griswold \u2013 \u201chas committed or is about to commit a breach or neglect of duty or other wrongful act.\u201d\u00a0<\/p>\n<p>If Section 3 only bars individuals from holding office, not seeking or winning it, Griswold \u201cwill not breach or neglect any \u2018duty\u2019 or commit a \u2018wrongful act\u2019 under the Fourteenth Amendment by listing President Trump on the ballot,\u201d Trump\u2019s lawyers said.\u00a0\u00a0<\/p>\n<p>\u201cIt\u2019s a pretty open-ended argument that has not gotten a lot of traction, and it would only apply to Colorado,\u201d Muller said. \u201cI think there\u2019s a limitation to how this applies in this context, and maybe a reason why it didn\u2019t get a lot of attention \u2013 it might not go very far.\u201d<\/p>\n<\/div>\n<p>Copyright 2024 Nexstar <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/social-mediaa\/\" data-internallinksmanager029f6b8e52c=\"1\" title=\"Social Media\" target=\"_blank\" rel=\"noopener\">Media<\/a> Inc.
