In court, the startup alleged that Meta violated U.S. antitrust law by copying its core features and suppressing competition. U.S. District Judge Kiyo Matsumoto in 2023 granted Meta\u2019s motion to dismiss the complaint due to time limits imposed by the relevant statutes of limitations. However, upon appeal, the court found that the case should have been heard because these time limits should not have applied.<\/p>\n<p class=\"wp-block-paragraph\">The decision means that Phhhoto will get another shot at arguing that Meta behaved in an anti-competitive fashion, ultimately putting its company out of business after copying its features and restricting its growth. <\/p>\n<p class=\"wp-block-paragraph\">The <a rel=\"nofollow\" target=\"_blank\" rel=\"nofollow\" href=\"https:\/\/www.courtlistener.com\/docket\/67523319\/phhhoto-inc-v-meta-platforms-inc\/\">case<\/a> calls into question if and how Meta used the introduction of an algorithm feed on Instagram to suppress Phhhoto\u2019s content, which led to a decline in Phhhoto\u2019s user registrations and engagement while Meta\u2019s own app gained traction. <\/p>\n<p class=\"wp-block-paragraph\">Phhhoto claims that it discovered the algorithmic manipulation when it used a different account to post a video on Instagram. The same post never gained traction when shared on Phhhoto\u2019s own account, but the other account\u2019s video received more likes and views, even though Phhhoto\u2019s account had 500 times more followers, the lawsuit states.<\/p>\n<p class=\"wp-block-paragraph\">The district court never ruled on these claims because the judge determined the antitrust law known as the <a rel=\"nofollow\" target=\"_blank\" rel=\"nofollow\" href=\"https:\/\/www.ftc.gov\/advice-guidance\/competition-guidance\/guide-antitrust-laws\/antitrust-laws\">Sherman Act\u2019s<\/a> four-year statute of limitations had run out.<\/p>\n<p class=\"wp-block-paragraph\">Phhhoto also argues that Meta used other anticompetitive tactics to hurt its business. <\/p>\n<p class=\"wp-block-paragraph\">For instance, ahead of Instagram\u2019s launch of an algorithmic feed in March 2016, Phhhoto alleged that Meta withdrew its access to the \u201cFind Friends\u201d API, which allows third-party apps such as itself to tap into Meta\u2019s social graph. In addition, Meta terminated its plans to integrate Phhhoto\u2019s content into the Facebook <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/news\/\" data-internallinksmanager029f6b8e52c=\"2\" title=\"News\" target=\"_blank\" rel=\"noopener\">News<\/a> Feed, as planned, the lawsuit states. The company found out in December 2018, when documents filed in a federal lawsuit in California were made public, that Meta had run a program called <a rel=\"nofollow\" target=\"_blank\" rel=\"nofollow\" href=\"https:\/\/www.nytimes.com\/2021\/09\/21\/technology\/zuckerberg-facebook-project-amplify.html\">Project Amplify,<\/a> which manipulated and reordered posts and content in consumers\u2019 feeds for Meta\u2019s benefit. <\/p>\n<p class=\"wp-block-paragraph\">While the appeals court isn\u2019t making a final decision on the case itself (as it never got to the point of a ruling), it did conclude that the lower court erred at \u201ceach step of the fraudulent concealment analysis,\u201d which means the court\u2019s earlier decision against Phhhoto\u2019s antitrust claim was untimely and the case should be heard. <\/p>\n<p class=\"wp-block-paragraph\">The case will be sent back to the district court to be tried. <\/p>\n<p class=\"wp-block-paragraph\">Responding to a request for comment, a Meta spokesperson said \u201cAs we have said since the beginning, this suit is baseless and we will continue to vigorously defend ourselves.\u201d <\/p>\n<p class=\"wp-block-paragraph\"><em>Updated after publication with Meta comment. <br \/><\/em><\/p>\n<\/div>\n<p><script async src=\"\/\/www.instagram.com\/embed.js\"><\/script><\/p>\n<blockquote><p><strong><span style=\"color: #ff6600;\">If you liked the article, do not forget to share it with your friends.
