\n The family of an unarmed man killed by cops during a routine traffic stop last year has brought a $350 million potential class action lawsuit against the city and the NYPD for an alleged pattern of racial profiling and excessive use of force, new court papers show.<\/p>\n

The family of Allan Feliz \u2014 an ex-con who was shot by cops Oct. 17 in the Bronx during a traffic stop over seat belts \u2014 filed suit in Bronx Supreme Court Wednesday alleging the 31-year-old man\u2019s wrongful death.<\/p>\n

Feliz\u2019s brother Sammy Feliz and his girlfriend Julie Aquino have also filed potential class action claims against the city and the NYPD claiming in the Bronx during at least as early as 2010 through the present the city, \u201csanctioned, supported and\/or otherwise acquiesced the use of racial profiling as a tool for law enforcement, including traffic stops.\u201d<\/p>\n

The suit also alleges, \u201cThat in the City of New York, County of Bronx, since at least 2010 and up to the present time, the defendants utilized excessive force during traffic stops.\u201d<\/p>\n

Police Officer Edward Barrett, Sgt. Jonathan Rivera and Officer Michelle Almanzar pulled over Feliz and a passenger because they believed the men inside weren\u2019t wearing seat belts \u2014 though they were, video from the incident shows.<\/p>\n

Barrett ran the license for Feliz \u2014\u00a0 who once served five years on a burglary conviction \u2014 and found an open warrant before patting him down outside the car. A violent struggle began when Feliz got back into the car and it moved, prompting the cops \u2014 who believed he was trying to drive away \u2014 to taser him and try to pull him out of the car.<\/p>\n

\u201cYo bro I\u2019m going to fucking shoot you,\u201d Rivera could be heard saying in the video while Barrett yelled for Feliz to \u201cput it in park, put it in park.\u201d<\/p>\n

Rivera eventually fired a single shot killing Feliz \u2014 the father of a then-6-month-old whom he had with Aquino.<\/p>\n

The lawsuit claims that Feliz wasn\u2019t trying to drive away but rather when he got back in the car it \u201cwas caused to shift forward.\u201d<\/p>\n

\u201cMy office has filed a lawsuit on behalf of the Feliz family for the assassination of Allan Feliz, their son, father, brother and friend who was gunned down by the police who had illegally racially profiled him,\u201d lawyer Robert Vilensky told The Post. \u201cThe lawsuit is also filed on behalf of all others in the City of New York who have been illegally subjected to racial profiling and police brutality.\u201d<\/p>\n

The suit is seeking $100 million in damages for the family and another $250 million in damages for anyone in the potential class action.<\/p>\n

As of January, the incident was being investigated by the NYPD and the state Attorney General<\/a>\u2019s office. The status of the investigation was not immedia<\/a>tely known.<\/p>\n

NYPD spokesperson Sgt. Mary Frances O\u2019Donnell said, \u201cwe decline to comment on pending litigation.\u201d<\/p>\n

Kimberly Joyce, a rep with the city Law Department said, \u201cWe will review the complaint when served and respond accordingly.\u201d<\/p>\n

The cops \u2014 who are named as defendants \u2014 could not immediately be reached for comment. It was not immediately clear who be representing them in the case.<\/p>\n
