JAY-Z has filed a memo with additional arguments to dismiss a Jane Doe\u2019s lawsuit against him for sexual assault, following up on his initial attempt to get the case dismissed earlier this month.<\/p>\n
In the new document, filed in federal court on Wednesday (January 29) and seen by HipHopDX<\/em>, Hov\u2019s attorney Alex Spiro argues that the alleged victim\u2019s lawyer Tony Buzbee \u201cgot basic facts wrong\u201d in the complaint.<\/p>\n AD LOADING…<\/p>\n<\/div>\n The lawsuit accuses JAY and Diddy of raping a then-13-year-old girl at a party following the 2000 Video Music Awards.<\/p>\n In his letter, Spiro noted that Doe\u2019s own father said he had no recollection of her version of events, which included him making what would be a 10-hour roundtrip<\/a> drive from Rochester, New York to pick her up in NYC on the night she alleges the rapp<\/a>er sexually assaulted her alongside Diddy.<\/p>\n Spiro also made note of multiple inaccuracies in Doe\u2019s story, including a claim (in an interview, not in the suit itself) of talking to a celebrity who wasn\u2019t in New York at the time.<\/p>\n \u201cMr. Carter seeks only to hold Mr. Buzbee to the ethical standards that constrain any responsible attorney who would solemnly sign his name to allegations in court,\u201d Spiro wrote, arguing that Buzbee should be sanctioned for either failing to certify Doe\u2019s claims or knowingly filing a false claim.<\/p>\n Spiro first filed his motion to have the case dismissed on January 8.<\/p>\n In it, the attorney\u00a0poked various holes in the woman\u2019s account and called for Buzbee to be sanctioned for failing to properly vet her claims before filing a lawsuit on her behalf.<\/p>\n Spiro\u2019s new memo responded to some points Buzbee raised in a lengthy defense of his suit that the Texas attorney filed with the court last Wednesday (January 22), in response to Spiro\u2019s January 8 letter.<\/p>\n Specifically, Buzbee said that, contrary to Spiro\u2019s claims, he had investigated the woman\u2019s story prior to filing his lawsuit. He said that he \u201cran a background check on plaintiff and retained a retired police detective to research and confirm other aspects of plaintiff\u2019s account.\u201d<\/p>\n \u201c[N]one of those individuals has even been named, let alone produced as a declarant,\u201d Spiro fired back in the new letter. \u201cNor does the Opposition specify which \u2018aspects\u2019 of Plaintiff\u2019s complaint were \u2018fact-checked.’\u201d<\/p>\n In response to Spiro\u2019s latest letter, Tony Buzbee told HipHopDX<\/em>: \u201cWith every frantic filing the defense in this case grows more desperate. The rules apply equally to everyone, even those who wrongly think they are above the law. No one is above the law.
