The act officially went into force August 1; what\u2019s now following is the first of the compliance deadlines.<\/p>\n<p class=\"wp-block-paragraph\"><a rel=\"nofollow\" target=\"_blank\" href=\"https:\/\/artificialintelligenceact.eu\/article\/5\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">The specifics are set out in Article 5<\/a>, but broadly, the Act is designed to cover a myriad of use cases where AI might appear and interact with individuals, from consumer applications through to physical environments.<\/p>\n<p class=\"wp-block-paragraph\">Under the\u00a0<a rel=\"nofollow\" target=\"_blank\" href=\"https:\/\/ec.europa.eu\/commission\/presscorner\/detail\/en\/qanda_21_1683\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">bloc\u2019s approach<\/a>, there are four broad risk levels: (1) Minimal risk (e.g., email spam filters) will face no regulatory oversight; (2) limited risk, which includes customer service chatbots, will have a light-touch regulatory oversight; (3) high risk \u2014 AI for healthcare recommendations is one example \u2014 will face heavy regulatory oversight; and (4) unacceptable risk applications \u2014 the focus of this month\u2019s compliance requirements \u2014 will be prohibited entirely. <\/p>\n<p class=\"wp-block-paragraph\">Some of the unacceptable activities include:<\/p>\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\">AI used for <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/social-mediaa\/\" data-internallinksmanager029f6b8e52c=\"1\" title=\"Social Media\" target=\"_blank\" rel=\"noopener\">social<\/a> scoring (e.g., building risk profiles based on a person\u2019s behavior).<\/li>\n<li class=\"wp-block-list-item\">AI that manipulates a person\u2019s decisions subliminally or deceptively.<\/li>\n<li class=\"wp-block-list-item\">AI that exploits vulnerabilities like age, disability, or socioeconomic status.<\/li>\n<li class=\"wp-block-list-item\">AI that attempts to predict people committing crimes based on their appearance.<\/li>\n<li class=\"wp-block-list-item\">AI that uses biometrics to infer a person\u2019s characteristics, like their sexual orientation.<\/li>\n<li class=\"wp-block-list-item\">AI that collects \u201creal time\u201d biometric data in public places for the purposes of law enforcement.<\/li>\n<li class=\"wp-block-list-item\">AI that tries to infer people\u2019s emotions at work or school.<\/li>\n<li class=\"wp-block-list-item\">AI that creates \u2014 or expands \u2014 facial recognition databases by scraping images online or from security cameras.<\/li>\n<\/ul>\n<p class=\"wp-block-paragraph\">Companies that are found to be using any of the above AI applications in the EU will be subject to fines, regardless of where they are headquartered. They could be on the hook for up to \u20ac35 million (~$36 million), or 7% of their annual revenue from the prior fiscal year, whichever is greater.<\/p>\n<p class=\"wp-block-paragraph\">The fines won\u2019t kick in for some time, noted Rob Sumroy, head of <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/technology\/\" data-internallinksmanager029f6b8e52c=\"4\" title=\"Technology\" target=\"_blank\" rel=\"noopener\">technology<\/a> at the British law firm Slaughter and May, in an interview with TechCrunch.<\/p>\n<p class=\"wp-block-paragraph\">\u201cOrganizations are expected to be fully compliant by February 2, but\u00a0\u2026 the next big deadline that companies need to be aware of is in August,\u201d Sumroy said. \u201cBy then, we\u2019ll know who the competent authorities are, and the fines and enforcement provisions will take effect.\u201d<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-preliminary-pledges\"><span class=\"ez-toc-section\" id=\"Preliminary_pledges\"><\/span>Preliminary pledges<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p class=\"wp-block-paragraph\">The February 2 deadline is in some ways a formality. <\/p>\n<p class=\"wp-block-paragraph\">Last September, over 100 companies signed the EU AI Pact, a voluntary pledge\u00a0to start applying the principles of the\u00a0AI Act\u00a0ahead of its entry into application. As part of the Pact, signatories \u2014 which included Amazon, Google, and OpenAI \u2014 committed to identifying AI systems likely to be categorized as high risk under the AI Act.<\/p>\n<p class=\"wp-block-paragraph\">Some tech giants, notably Meta and Apple, skipped the Pact. French AI startup Mistral, one of the AI Act\u2019s harshest critics, also opted not to sign. <\/p>\n<p class=\"wp-block-paragraph\">That isn\u2019t to suggest that Apple, Meta, Mistral, or others who didn\u2019t agree to the Pact won\u2019t meet their obligations \u2014 including the ban on unacceptably risky systems. Sumroy points out that, given the nature of the prohibited use cases laid out, most companies won\u2019t be engaging in those practices anyway.<\/p>\n<p class=\"wp-block-paragraph\">\u201cFor organizations, a key concern around the EU AI Act is whether clear guidelines, standards, and codes of conduct will arrive in time \u2014 and crucially, whether they will provide organizations with clarity on compliance,\u201d Sumroy said. \u201cHowever, the working groups are, so far, meeting their deadlines on the code of conduct for\u00a0\u2026 developers.\u201d<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-possible-exemptions\"><span class=\"ez-toc-section\" id=\"Possible_exemptions\"><\/span>Possible exemptions<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p class=\"wp-block-paragraph\">There are exceptions to several of the AI Act\u2019s prohibitions.<\/p>\n<p class=\"wp-block-paragraph\">For example, the Act permits law enforcement to use certain systems that collect biometrics in public places if those systems help perform a \u201ctargeted search\u201d for, say, an abduction victim, or to help prevent a \u201cspecific, substantial, and imminent\u201d threat to life. This exemption requires authorization from the appropriate governing body, and the Act stresses that law enforcement can\u2019t make a decision that \u201cproduces an adverse legal effect\u201d on a person solely based on these systems\u2019 outputs.<\/p>\n<p class=\"wp-block-paragraph\">The Act also carves out exceptions for systems that infer emotions in workplaces and schools where there\u2019s a \u201cmedical or safety\u201d justification, like systems designed for therapeutic use.<\/p>\n<p class=\"wp-block-paragraph\">The European Commission, the executive branch of the EU, <a rel=\"nofollow\" target=\"_blank\" href=\"https:\/\/digital-strategy.ec.europa.eu\/en\/news\/commission-launches-consultation-ai-act-prohibitions-and-ai-system-definition\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">said that it would release additional guidelines<\/a> in \u201cearly 2025,\u201d following a consultation with stakeholders in November. However, those guidelines have yet to be published.<\/p>\n<p class=\"wp-block-paragraph\">Sumroy said it\u2019s also unclear how other laws on the books might interact with the AI Act\u2019s prohibitions and related provisions. Clarity may not arrive until later in the year, as the enforcement window approaches.<\/p>\n<p class=\"wp-block-paragraph\">\u201cIt\u2019s important for organizations to remember that AI regulation doesn\u2019t exist in isolation,\u201d Sumroy said. \u201cOther legal frameworks, such as GDPR, NIS2, and DORA, will interact with the AI Act, creating potential challenges \u2014 particularly around overlapping incident notification requirements.
