\n A former fed who trained the police in Buffalo believes the elderly protester who was hospitalized after a cop pushed him to the ground \u201cgot away lightly\u201d and \u201ctook a dive,\u201d according to a report.<\/p>\n

The retired FBI agent, Gary DiLaura, told The Sun he thinks there\u2019s no chance Buffalo officers will be convicted of assault over the now-viral video showing the longtime peace activist Martin Gugino fall and left bleeding on the ground.<\/p>\n

\u201cI can\u2019t believe that they didn\u2019t deck him. If that would have been a 40-year-old guy going up there, I guarantee you they\u2019d have been all over him,\u201d DiLaura said.<\/p>\n

\u201cHe absolutely got away lightly. He got a light push and in my humble opinion, he took a dive and the dive backfired because he hit his head. Maybe it\u2019ll knock a little bit of sense into him,\u201d added the former fed, who trained Buffalo police on firearms and defensive tactics, according to the report.<\/p>\n

\u201cThese cops were acting how they have been trained to act. There\u2019s no way they are going to be convicted of assault.\u201d<\/p>\n

Gugino\u2019s lawyer said Thursday the 75-year-old activist suffered a brain injury. His friends previously described him as a \u201cgentle person.\u201d<\/p>\n

The two officers, Aaron Torgalski and Robert McCabe, were both charged with second-degree assault and suspended \u2014 leading to dozens of cops resigning from the emergency team, but not the police force, as an act of solidarity.<\/p>\n

DiLaura also offered his services at the officers\u2019 trial to \u201ctestify in court that these case officers did exactly what they were trained to do and exercised exemplary control.\u201d<\/p>\n

The former fed told The Sun the device Gugino was holding \u201ccould be a smartphone\u201d or \u201ccould be a little bomb.\u201d<\/p>\n

\u201cThey have no idea what this guy\u2019s doing. Put yourself in their spot, here\u2019s a guy who has no business being here. This guy\u2019s obviously an old man. He should not be here.\u201d<\/p>\n

President Trump weighed in on the incident earlier this week claiming, without evidence, Gugino \u201ccould be an ANTIFA provocateur\u201d and suggested it was a \u201cset up.\u201d\n <\/p><\/div>\n<\/p><\/div>\n<\/p><\/div>\n<\/div>\n
