The two sides agreed to halt the enforcement of the law until <em>Mozilla v. FCC<\/em>, a case that challenged the FCC\u2019s repeal of net neutrality, was settled by the United States Court of <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">App<\/a>eals District of Columbia Circuit. <\/p>\n<p>Last year, a panel of three judges from that court handed down its decision, which largely upheld the FCC\u2019s repeal, but vacated a portion of it that blocked states from enacting their own laws. <\/p>\n<p>With that decided, the two sides agreed to resume their fight over California\u2019s law. The Justice Department is arguing that the law is \u201cpreempted by federal law and therefore violates the Supremacy Clause of the United States Constitution.\u201d <\/p>\n<p>Meanwhile, California has argued that there is no federal law preventing the state from enacting its net neutrality law. Attorney <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/general\/\" data-internallinksmanager029f6b8e52c=\"3\" title=\"General\" target=\"_blank\" rel=\"noopener\">General<\/a> Xavier Becerra also argued that the Justice Department\u2019s request for an injunction didn\u2019t show that there would be irreparable harm as a result of the law. <\/p>\n<p>The two different briefs filed on Wednesday were put together by some of the biggest groups who advocate for net neutrality. One <a rel=\"nofollow noopener noreferrer\" target=\"_blank\" href=\"https:\/\/www.eff.org\/files\/2020\/09\/30\/eff_aclu_and_allies_2020-09-30_brief_amicus_curiae_aca_v_becerra.pdf\">filing<\/a> is signed on by the Electronic Frontier Foundation (EFF), the ACLU of Northern California, Fight for the Future, Media Justice, the National Hispanic Media Coalition, and Reddit. The <a rel=\"nofollow noopener noreferrer\" target=\"_blank\" href=\"https:\/\/www.freepress.net\/sites\/default\/files\/2020-10\/2020_09_30_Amicus_Brief_%20Access_Now_et_al.pdf\">other brief<\/a> is headlined by Mozilla, Public Knowledge, and Free Press. <\/p>\n<p>The two briefs argue in favor of California\u2019s law and urge the court to deny the request for an injunction from the Justice Department.<\/p>\n<p>\u201cThe public has a strong and abiding interest in protecting fair access to the internet and ensuring that the private motivations of local monopolies do not result in systemic harm to Californians,\u201d the brief from EFF and other groups reads. \u201cThat\u2019s why a coalition representing diverse interests campaigned in favor of SB 822\u2019s essential protections.
