\n A Bronx prosecutor says an NYPD officer sexually assaulted her and an investigator from the Bronx District Attorney\u2019s office raped her \u2014 but both agencies ignored the allegations, according to a new lawsuit.<\/p>\n

The woman, identified as Jane Doe, claims Officer Edwin Crespo slid his hand up her thigh in her cubicle on Nov. 15, 2016 while they were preparing for trial, according to the federal lawsuit filed in the Southern District of New York on Oct. 8.<\/p>\n

\u201cAfter moving his chair so close to Plaintiff\u2019s so that their chairs were basically touching, Officer Crespo placed his hand on Plaintiff\u2019s right inner thigh and slid his hand up and down her thigh,\u201d the suit reads. \u201cHis hand reached about one or two inches away from her vagina.\u201d<\/p>\n

Despite Doe reporting the incident, the Bronx District Attorney\u2019s Office \u201cmade no effort\u201d to \u201censure her health and safety by making some sort of alternative arrangements,\u201d the suit alleges.<\/p>\n

Crespo was later suspended over a domestic incident and arrested in June 2018 after allegedly drunkenly crashing into a marked NYPD car, but nothing ever came of the unnamed woman\u2019s allegations, according to the suit.<\/p>\n

Reached by phone, the now-retired cop confirmed he wasn\u2019t disciplined over the encounter.<\/p>\n

\u201cI was interviewed but they never found nothing\u2026 nothing came out of it,\u201d he said before abruptly hanging up.<\/p>\n

In another separate incident, the lawsuit accuses Gino Pelaez, a senior accountant investigator in the DA\u2019s office, of rape following a party with colleagues on Aug. 15, 2019.<\/p>\n

The suit claims Pelaez followed Doe to into her cab where he became \u201cvulgar and aggressive,\u201d trying to kiss the woman and telling her \u201cIt\u2019s OK, you want it,\u201d when she tried to fend him off.<\/p>\n

She alleges he touched her inapp<\/a>ropriately during the cab ride and forced himself into her apartment, the suit says.<\/p>\n

\u201cIn the morning, Plaintiff woke up in her apartment, knowing she had been raped. Her body was \u2018black and blue\u2019 and her vaginal area was injured to the point where she could not sit down or urinate comfortably for weeks,\u201d the lawsuit says.<\/p>\n

The woman immedia<\/a>tely alerted her supervisors and made a report with NYPD Special Victims Unit and Manhattan DA\u2019s Office. That\u2019s when the NYPD\u2019s Internal Affairs finally contacted her about her run-in with Crespo, the suit says.<\/p>\n

A few days later, Pelaez apologized for his behavior, the suit says.<\/p>\n

The lawsuit claims the DA\u2019s office \u201cbotched\u201d the investigation by outing witnesses in email chains and sharing a confidential subpoena \u201cimproperly.\u201d<\/p>\n

No charges were brought in the case due to a \u201cnotorious loophole\u201d in New York law that says \u201cvoluntarily intoxicated individual is not considered mentally incapacitated,\u201d the suit reads.<\/p>\n

That loophole, according to the suit, leads to few charges in \u201ccases where the victim became voluntarily intoxicated and was unable to consent, even if a reasonable person would have understood that the victim was incapacitated.\u201d<\/p>\n

The Bronx District Attorney\u2019s Office and NYPD both declined to comment on pending litigation.<\/p>\n

Pelaez could not be reached for comment.<\/p>\n

Lawyer and PR specialist Josh Nass said of the damning allegations in the lawsuit, \u201cit\u2019s a crisis from a PR standpoint.\u201d<\/p>\n

\u201cIt\u2019s unfathomable in the Me Too era in which we live a human resource department at major district attorney\u2019s office would be so negligent and grossly reckless and irresponsible this is a matter that obviously it\u2019s an outrage if true,\u201d said Nass, who works as CEO of Dignified Online.\n <\/p><\/div>\n
