When hospitals\u2019 own resources became overwhelmed, the Strategic National Stockpile dusted off and distributed thousands of the life-support machines throughout the country.<\/p>\n<p>But&nbsp;<a href=\"https:\/\/apnews.com\/article\/f43781b64bacd6aa094d9404f4ab91a4\" target=\"_blank\" rel=\"nofollow noopener\">not all<\/a>&nbsp;were in working condition.<\/p>\n<p>J. Scot Mackeil, a biomedical technician with more than 40 years of experience, worked on a team tasked with inspecting machines sent to Massachusetts\u2019s Emergency Management Agency. In mid-April, while performing spot checks on hundreds of ventilators packed in freight pods, Mackeil discovered one with a damaged power connector.<\/p>\n<p>But when he asked the manufacturer to send him a replacement part, he was surprised to receive the manufacturer\u2019s response: \u201c&nbsp;\u2018Absolutely no.\u2019&nbsp;\u201d<\/p>\n<p>\u201cI had just expected, \u2018Oh, no problem. Where can we send it?\u2019 \u201d he said. \u201cI wasn\u2019t expecting them to dig their heels in.\u201d<\/p>\n<p>Mackeil was well aware of what\u2019s become a common obstacle for hospitals: Manufacturers not only have a monopoly over even simple replacement parts, but they also often allow only their authorized service technicians to repair equipment.<\/p>\n<p>Mackeil told The Markup that over his career, manufacturers resisting hospitals doing their own repairs has become the norm.<\/p>\n<p>\u201cMedical equipment manufacturers look at the service phase of the device life as a huge profit center,\u201d Mackeil said.<\/p>\n<p>With the ventilator, he had thought they might relent.<\/p>\n<p>\u201cIt was just a shame,\u201d he said.<\/p>\n<p>It\u2019s not just medical device manufacturers who keep a tight grip on the inner workings of the products they sell\u2014<a href=\"https:\/\/www.cultofmac.com\/411395\/everything-you-need-to-know-about-ios-crippling-error-53\/\" target=\"_blank\" rel=\"nofollow noopener\">mobile phones<\/a>,&nbsp;<a href=\"https:\/\/www.polygon.com\/2018\/4\/13\/17231520\/ftc-warning-video-game-console-makers\" target=\"_blank\" rel=\"nofollow noopener\">game consoles<\/a>,&nbsp;<a href=\"https:\/\/www.facebook.com\/photo.php?fbid=10207166763521072&amp;set=a.1771733506766.94455.1642136739&amp;type=3&amp;theater\" target=\"_blank\" rel=\"nofollow noopener\">coffee makers<\/a>, and&nbsp;<a href=\"https:\/\/www.vice.com\/en_us\/article\/kzp7ny\/tractor-hacking-right-to-repair\" target=\"_blank\" rel=\"nofollow noopener\">farm equipment<\/a>&nbsp;all share examples of the same sort of repair restrictions that advocates calling for \u201cright to repair\u201d laws seek to eliminate.<\/p>\n<p>And though you might technically own your camera, <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/game\/\" data-internallinksmanager029f6b8e52c=\"7\" title=\"Game\" target=\"_blank\" rel=\"noopener\">game<\/a> console, blender, or phone, you repair it at your own peril. Going outside the official route for fixes is either impractical without repair manuals and proprietary tools or could void the machine\u2019s warranty (though consumers&nbsp;<a href=\"https:\/\/www.ftc.gov\/news-events\/press-releases\/2018\/04\/ftc-staff-warns-companies-it-illegal-condition-warranty-coverage\" target=\"_blank\" rel=\"nofollow noopener\">have some protections<\/a>&nbsp;on that front).<\/p>\n<p>\u201cWe are no longer able to fix the things we buy,\u201d said Gay Gordon-Byrne, who is the executive director of&nbsp;<a href=\"https:\/\/repair.org\/\" target=\"_blank\" rel=\"nofollow noopener\">The Repair Association<\/a>, a coalition of businesses and organizations seeking legislation across the country that would give consumers the right to repair their own machines.<\/p>\n<p>The right-to-repair movement has drawn an unusual coalition of stakeholders, including environmentalists, libertarians, engineers, independent repair shop owners, gamers, hobbyists, and farmers.<\/p>\n<p>Groups like The Repair Association have helped push consumer electronic right-to-repair bills introduced in dozens of states. None, however, have become law in recent years.<\/p>\n<p>Lobbyists for the electronics manufacturers have also raised concerns that unqualified repairs could lead to&nbsp;<a href=\"http:\/\/technet-6360de.webflow.io\/state-policy\/privacy-security\" target=\"_blank\" rel=\"nofollow noopener\">dangerous failures of their products<\/a>&nbsp;and that states with right-to-repair laws could become&nbsp;<a href=\"https:\/\/www.vice.com\/en_us\/article\/pgxgpg\/apple-tells-lawmaker-that-right-to-repair-iphones-will-turn-nebraska-into-a-mecca-for-hackers\" target=\"_blank\" rel=\"nofollow noopener\">havens for hackers<\/a>.<\/p>\n<p>Such laws could eliminate a manufacturer\u2019s monopoly on not only who can fix a product\u2014but also on when a product is essentially deemed unfixable.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Why_wont_Apple_fix_my_phone_Can_someone_else_do_it\"><\/span><strong>Why won\u2019t Apple fix my phone? Can someone else do it?&nbsp;<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Today\u2019s mobile phone is a marvel of precision engineering\u2014watertight seams, sealed batteries, and a lack of visible fasteners that would make most consumers unsure of how you would even go about opening it. To get inside requires detailed schematics, diagrams, and specialized tools.<\/p>\n<p><a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">App<\/a>le has all of those, of course, but in July 2019, Apple VP Kyle Andeer&nbsp;<a href=\"https:\/\/docs.house.gov\/meetings\/JU\/JU05\/20190716\/109793\/HHRG-116-JU05-20190716-SD036.pdf\" target=\"_blank\" rel=\"nofollow noopener\">testified to Congress<\/a>&nbsp;that the company and its authorized service providers perform only four types of <a href=\"https:\/\/rapidiphone.repair\/iPhone-phones-repairs\" target=\"_blank\" rel=\"noopener\">iPhone repair<\/a>: display, battery, speaker, and camera. If your phone dies (when it is no longer covered by warranty or optional AppleCare coverage) and it can\u2019t be fixed by one of those repairs, Apple may suggest you buy another phone.<\/p>\n<p>Jessa Jones, founder of&nbsp; iPad Rehab, a mobile device repair shop in Honeoye Falls, N.Y., says that\u2019s disingenuous.<\/p>\n<p>\u201cI think that my customers are largely unaware that what they\u2019re being told by the manufacturer of the device, about the problem that they\u2019re having and about the repairability of that problem, is false,\u201d she told The Markup.<\/p>\n<p>\u201cWe aim to avoid the need for repair in the first place,\u201d Apple spokesperson Keri Fulton said in a statement to The Markup. \u201cBut when a repair is needed, there should be safe, dependable options available to bring a device back to its best possible performance.\u201d<\/p>\n<p>Jones runs a popular&nbsp;<a href=\"https:\/\/www.youtube.com\/channel\/UCPjp41qeXe1o_lp1US9TpWA\" target=\"_blank\" rel=\"nofollow noopener\">YouTube channel<\/a>&nbsp;on which she&nbsp;<a href=\"https:\/\/www.youtube.com\/watch?v=NPKI5Y_kn4s\" target=\"_blank\" rel=\"nofollow noopener\">uses her soldering skills<\/a>&nbsp;under a microscope to perform several repairs that Apple does not offer.<\/p>\n<p>She particularly specializes in restoring data from dead phones\u2014often helping people recover precious photos of loved ones.<\/p>\n<p>\u201cThere\u2019s a chip on the board that is soldered on there that contains all of your memories, and those memories are encrypted by default,\u201d Jones said, and it\u2019s time-consuming though entirely possible to retrieve.<\/p>\n<p>\u201cThe only way to decrypt that and get them back out is you\u2019ve got to get a multi-meter out and solve problems on that logic board,\u201d she said.<\/p>\n<p>Jones also noted that there are many relatively simple repairs that shouldn\u2019t require a <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/trip-and-travel\/\" data-internallinksmanager029f6b8e52c=\"10\" title=\"Trip &amp; Travel\" target=\"_blank\" rel=\"noopener\">trip<\/a> to the Apple Store or an authorized dealer.<\/p>\n<p>Tips are easy to find online, and sites like&nbsp;<a href=\"https:\/\/www.ifixit.com\/\" target=\"_blank\" rel=\"nofollow noopener\">iFixit<\/a>&nbsp;offer detailed repair guides, tools, and replacement parts. Independent phone repair shops can be found in towns large and small, but they often operate without official manufacturer certifications to repair devices. These shops may use unofficial aftermarket parts from overseas, or replacement parts harvested from inoperable phones.<\/p>\n<p>But like many other device manufacturers, Apple increasingly employs strict digital controls over the hardware that the device detects, making non-Apple repairs of some components impossible without Apple diagnostic tools.<\/p>\n<p>\u201cOur ability to just take something from the junkyard of iPhone parts and plug it into your new phone is becoming increasingly limited, because the parts are now serialized, meaning there\u2019s a serial number in the part that the phone refuses to operate [without],\u201d said Jones.<\/p>\n<p>Fulton from Apple declined to comment but pointed The Markup to the company\u2019s&nbsp;<a href=\"https:\/\/www.apple.com\/environment\/pdf\/Apple_Environmental_Progress_Report_2020.pdf\" target=\"_blank\" rel=\"nofollow noopener\">2020 Environment Report<\/a>, which says products are becoming easier to repair.<\/p>\n<p>\u201cFor our iPhone devices, we\u2019ve utilized stretch release adhesives, which securely hold the battery during use yet can be swiftly debonded by service partners to install replacements,\u201d the report says.<\/p>\n<p>Apple is not alone in making devices that are hard to repair. Jones said manufacturers of Android devices employ manufacturing techniques that make repairs difficult. iFixit CEO Kyle Wiens told The Markup, though, that there are manufacturers who are voluntarily adopting&nbsp;<a href=\"https:\/\/www.ifixit.com\/Manifesto\" target=\"_blank\" rel=\"nofollow noopener\">right-to-repair principles<\/a>.<\/p>\n<p>\u201cMotorola is the first smartphone manufacturer that stepped up and is basically complying with right to repair,\u201d he said. \u201cThey have worked with us.\u201d<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Theres_a_diverse_growing_movement_behind_the_right_to_repair_%E2%80%94_but_it_faces_hurdles\"><\/span><strong>There\u2019s a diverse, growing movement behind the right to repair \u2014 but it faces hurdles&nbsp;<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Some of the earliest calls for right-to-repair legislation came from farmers, who\u2019ve been struggling for the ability to fix their own John Deere tractors for years. John Deere equipment is sold with software restrictions that only authorized technicians can bypass,&nbsp;<a href=\"https:\/\/www.vice.com\/en\/article\/xykkkd\/why-american-farmers-are-hacking-their-tractors-with-ukrainian-firmware\" target=\"_blank\" rel=\"nofollow noopener\">frustrating traditionally self-reliant farmers<\/a>.<\/p>\n<p>During their campaigns for president, both Elizabeth Warren and Bernie Sanders&nbsp;<a href=\"https:\/\/medium.com\/@teamwarren\/leveling-the-playing-field-for-americas-family-farmers-823d1994f067\" target=\"_blank\" rel=\"nofollow noopener\">cited the plight of these farmers<\/a>&nbsp;<a href=\"https:\/\/gizmodo.com\/hell-yeah-bernie-sanders-just-endorsed-a-national-righ-1834550743\" target=\"_blank\" rel=\"nofollow noopener\">unable to repair<\/a>&nbsp;their own equipment and called for a national right-to-repair law as part of a host of proposals to help American farmers that ended up being adopted as&nbsp;<a href=\"https:\/\/democrats.org\/where-we-stand\/party-platform\/building-a-stronger-fairer-economy\/\" target=\"_blank\" rel=\"nofollow noopener\">a plank in the Democratic platform<\/a>&nbsp;for 2020.<\/p>\n<p>A spokesperson for John Deere declined to comment.<\/p>\n<p>The company has recently made an effort to smooth things over,&nbsp;<a href=\"https:\/\/r2rsolutions.org\/\" target=\"_blank\" rel=\"nofollow noopener\">offering a program<\/a>&nbsp;with diagnostics, training, and documentation for farmers wanting to do their own repairs, starting in 2021.<\/p>\n<p>In 2018, an&nbsp;<a href=\"https:\/\/www.ifixit.com\/News\/11951\/1201-copyright-final-rule\" target=\"_blank\" rel=\"nofollow noopener\">alliance of right-to-repair advocates<\/a>&nbsp;won long-sought exemptions to the Digital Millennium Copyright Act to allow farmers and other consumers to&nbsp;<a href=\"https:\/\/www.theverge.com\/news\/18024332us-copyright-office-right-to-repair-dcma-exemptions\" target=\"_blank\" rel=\"nofollow noopener\">break software locks on the products they own<\/a>\u2014without breaking the law. These&nbsp;<a href=\"https:\/\/www.copyright.gov\/1201\/2018\/\" target=\"_blank\" rel=\"nofollow noopener\">latest exemptions<\/a>&nbsp;(which are considered every three years under the law) enable the legal \u201cjailbreaking\u201d of new phones, voice assistants, and software locks on tractors, cars, and home appliances\u2014though not on video game consoles. Importantly, they also allow you to hire someone to do this breaking for you.<\/p>\n<p>Massachusetts, where a voter-initiative&nbsp;<a href=\"https:\/\/malegislature.gov\/Laws\/SessionLaws\/Acts\/2013\/Chapter165\" target=\"_blank\" rel=\"nofollow noopener\">automotive right-to-repair law passed in 2012<\/a>&nbsp;with&nbsp;<a href=\"http:\/\/archive.boston.com\/news\/special\/politics\/2012\/general\/mass-ballot-question-1-election-results-2012.html\" target=\"_blank\" rel=\"nofollow noopener\">86 percent voting<\/a>&nbsp;in favor, shows the potential popularity of expanding such laws.<\/p>\n<p>This November, Massachusetts voters will consider an&nbsp;<a href=\"https:\/\/ballotpedia.org\/Massachusetts_Question_1,_%22Right_to_Repair_Law%22_Vehicle_Data_Access_Requirement_Initiative_(2020)\" target=\"_blank\" rel=\"nofollow noopener\">update to the automotive law<\/a>, which would allow consumers to access and control the automobile diagnostic and telemetric data that\u2019s increasingly sent directly to car manufacturers via cellular radios.<\/p>\n<p>Massachusetts also has a consumer electronics right-to-repair bill that advocates say is the furthest along of any in the country, though it\u2019s currently awaiting a vote by both chambers of the state legislature.<\/p>\n<p>The Massachusetts bill has served as a template for proposed automotive and consumer electronic right-to-repair legislation around the country\u2014some of which has&nbsp;come close to becoming law, only to be killed at the last minute by&nbsp;<a href=\"https:\/\/medium.com\/u-s-pirg\/how-big-tech-stopped-right-to-repair-in-new-york-9109a7565596\" target=\"_blank\" rel=\"nofollow noopener\">lobbying from electronics and automobile manufacturers<\/a>. New York State&nbsp;<a href=\"https:\/\/www.documentcloud.org\/documents\/7232115-NY-State-Lobbying.html\" target=\"_blank\" rel=\"nofollow noopener\">lobbying disclosures<\/a>&nbsp;for 2018, for instance, show that Apple, Verizon, <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/social-mediaa\/\" data-internallinksmanager029f6b8e52c=\"1\" title=\"Social Media\" target=\"_blank\" rel=\"noopener\">Facebook<\/a>, AT&amp;T, Toyota, Caterpillar, and others all successfully lobbied against a proposed \u201c<a href=\"https:\/\/nyassembly.gov\/leg\/?default_fld=&amp;leg_video=&amp;bn=A08192&amp;term=2017&amp;Summary=Y&amp;Actions=Y&amp;Committee%26nbspVotes=Y&amp;Text=Y\" target=\"_blank\" rel=\"nofollow noopener\">Fair Repair Act<\/a>.\u201d<\/p>\n<p>Industry groups opposing right to repair include Consumer Technology Association,&nbsp;<a href=\"https:\/\/www.aem.org\/advocacy-old\/right-to-repair\" target=\"_blank\" rel=\"nofollow noopener\">Association of Equipment Manufacturers<\/a>, and TechNet (a large industry group whose members include Apple, Amazon, Google, Facebook, and Comcast).<\/p>\n<p>In 2019, TechNet\u2019s then Northeast executive director,&nbsp;<a href=\"https:\/\/youtu.be\/QHpXJzjin7k?t=5994\" target=\"_blank\" rel=\"nofollow noopener\">Christina Fisher, testified<\/a>&nbsp;before the Massachusetts state legislature\u2019s Joint Committee on Consumer Protection and Professional Licensure in opposition to the proposed&nbsp;<a href=\"https:\/\/malegislature.gov\/Bills\/191\/H218\" target=\"_blank\" rel=\"nofollow noopener\">digital right-to-repair bill<\/a>.<\/p>\n<p>Fisher argued that the bill was \u201clegislation in search of a problem\u201d\u2014that consumers already have plenty of choices for repairs and that such laws would hurt innovation.<\/p>\n<p>TechNet declined to comment for this story, pointing The Markup to the group\u2019s previous statements.<\/p>\n<p>An all-star list of engineers and cyber security professionals founded&nbsp;<a href=\"https:\/\/securepairs.org\/\" target=\"_blank\" rel=\"nofollow noopener\">Securepairs<\/a>&nbsp;in 2018 to counter these arguments, which the group says are&nbsp;<a href=\"https:\/\/securepairs.org\/statement-of-principles\/#FUD\" target=\"_blank\" rel=\"nofollow noopener\">without merit<\/a>.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"What_comes_next\"><\/span><strong>What comes next?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>If Massachusetts were to pass the nation\u2019s first consumer electronic right-to-repair law, it could have national influence.
