Words matter, facts matter. So, Mayor de Blasio is right to sue the Trump White House for designing Gotham as \u201canarchist\u201d and potentially withholding federal funding.<\/p>\n<p>In September, President Trump issued an executive order introducing a new term in US governance: \u201canarchist jurisdiction.\u201d Citing New York, Portland and Seattle, the president said\u00a0Washington would \u201cdisfavor\u201d any city exhibiting anarchist tendencies when it comes to federal funding. The first example: a federal grant to study how to curb COVID on transit systems.<\/p>\n<p>For Americans interested in limited government, executive orders involving the budget are a red flag.<\/p>\n<p>In his suit, joined by the two other cities, de Blasio is right to argue that Congress, not the White House, governs the federal budget. Congress determines how to disperse federal grants, through formulas that take years of negotiations.<\/p>\n<p>Both parties should be worried at the president circumventing that process. A Democratic president could use the same discretion to bully a state or city to go along with his policies.<\/p>\n<p>Yes, President Barack Obama used the power of the purse to threaten to withhold funding from schools and universities that didn\u2019t follow his interpretation of what counts as sex discrimination.<\/p>\n<p>Agree or disagree, though, Obama was using discretion given to him under a specific law against sex discrimination, passed by Congress \u2014 and Congress is free to change the law.<\/p>\n<p>There\u2019s no law creating or defining \u201canarchist jurisdiction.\u201d Trump made it up. For New York City, the president defined it as \u201callow[ing] violence to spike, citing the near-doubling of shootings through mid-August. \u201cThe shooting victims include children as young as one year old,\u201d the president wrote. The memo cites looting and protest encampments, as well.<\/p>\n<p>There is no question that de Blasio has failed to control pandemic violence. Through mid-October, murder is up by a third, and shootings have doubled. But this violence is not anarchy, defined as the absence of government. New York still has plenty of government.<\/p>\n<p>Nor is the president <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>lying it consistently. The death of a baby is a tragedy \u2014 and one New York City should have prevented. These tragedies are too common \u2014 actually, more common \u2014 outside of New York City. In September, a 3-year-old boy was shot to death in Orlando. In January, a 1-year-old boy in Dallas was shot to death. The White House said nary a word.<\/p>\n<p>If we\u2019re going to define \u201canarchy\u201d as a high rate of street violence, New York would be on the bottom of the list. States with the highest rate of homicide are red states: Mississippi, Louisiana, Alabama, Missouri, New Mexico, South Carolina. That\u2019s true when we compare New York City against blue cities in red states, too.<\/p>\n<p>Then, too, is the president\u2019s troubling attention to local budgeting discretion. In declaring New York anarchist, Trump mentioned the City Council\u2019s $1 billion cut to the NYPD.<\/p>\n<p>It is indeed reckless \u2014 and a lot of grandstanding \u2014 for the City Council to \u201cdefund,\u201d or even to pretend to defund, the police.<\/p>\n<p>It is, nevertheless, a local issue. Will a Democratic president create a new definition of \u201canarchy\u201d to punish a red state that doesn\u2019t build enough public housing?<\/p>\n<p>It was similarly unwise for New York to \u201cdisband the NYPD\u2019s plainclothes anti-crime units,\u201d another Trump definition of anarchy.<\/p>\n<p>But that, too, is a matter of local discretion \u2014 as is a police department\u2019s approach to an encampment like the one in City Hall Park over the summer.<\/p>\n<p>Maybe it\u2019s good to go in with force and clear out a sleep-in right away. Maybe it\u2019s good to wait a week, if intelligence points to an armed presence spoiling for a shootout. Making federal funding dependent on such case-by-case tactical police decisions would be a disaster.<\/p>\n<p>In their suit, the three cities charge that Trump\u2019s memo \u201cviolate[s] bedrock principles of American democracy: separation of powers, federalism and due process.\u201d<\/p>\n<p>You can be worried about the decisions that New York, Portland and Seattle are making to protect the public welfare \u2014 but still agree this statement is true.
